AN ACT to add new Sections 294(c) and (d) to Article 66½ of the
Annotated Code of Maryland (1967 Replacement Volume), title
"Motor Vehicles," subtitle "Operation of Vehicles upon Highways,"
to follow immediately after Section 294 (b) thereof providing cer-
tain criteria for constructing and attaching certain types of muf-
flers and exhaust pipes, prohibiting the emission of excessive fumes
and smoke from motor vehicles, and establishing standards for
determining the excessiveness of such fumes and smoke.
Section 1. Be it enacted by the General Assembly of Maryland,
That new Sections 294(c) and (d) be and it is hereby added to
Article 66½ of the Annotated Code of Maryland (1967 Replacement
Volume), title "Motor Vehicles," subtitle "Operation of Vehicles upon
Highways," to follow immediately after Section 294(b) thereof, and
to read as follows:
294.
(c) All mufflers and exhaust pipes carrying exhaust gases from
the motor shall be constructed of leak-proof metal tubing and shall
be erected parallel to the ground and vehicle, or vertical, and, if
vertical, the exhaust from such pipes shall not be directed to the
side of the vehicle. On passenger vehicles such exhaust pipes shall
extend to the extreme rear of said vehicles. It shall be unlawful for
any person to use on the exhaust or "tail-pipe" of a motor vehicle
any extension or other device to cause excessive or unusual noise.
(d) The engine, power and exhaust mechanism of every motor
vehicle shall be so equipped, adjusted, and operated as to prevent the
escape therefrom CONTINUOUS EMISSION of excessive fumes or
smoke, but in no case shall such emission be:
(1) As dark or darker in shade as that designated as No. 2 3
on the Ringelmann Chart, as published by the United States Bureau
of Mines; or,
(2) Of such opacity as to obscure an observer's view to a degree
equal to or greater than does smoke described in paragraph (1) of
this subsection.
SEC. 2. And be it further enacted, That this Act shall take effect
July 1, 1968.
