503, 504, 505, 506, 507 AND Sections 500, 501, 502, 503, 504
505, 506, 507 and 508 limiting work or labor or the selling of
merchandise or articles or operation of specified places on certain
days in Montgomery County; to except certain persons in Mont-
gomery County observing a day other than Sunday as a day of
rest and recreation; to further regulate business in Montgomery
County regarding the work week; and to provide injunctive relief
and penalties for violations.
Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 492, 521, 522, 500, 501, 502, 503, 505, 506, 507
and 508, of Article 27 of the Annotated Code of Maryland (1967
Replacement Volume and 1967 Supplement), title and subtitle
"Crimes and Punishments," subheading "Sabbath Breaking," be and
they are hereby repealed as applicable with in Montgomery County
and that new Section 534G and 534H are hereby enacted to read as
follows:
THAT NEW SECTIONS 534G AND 534H ARE AND THEY
ARE HEREBY ADDED TO ARTICLE 27 OF THE ANNO-
TATED CODE OF MARYLAND (1967 REPLACEMENT VOL-
UME), TITLE "CRIMES AND PUNISHMENTS", SUBTITLED
"SABBATH BREAKING", TO FOLLOW IMMEDIATELY AF-
TER SECTION 534F THEREOF, AND TO READ AS FOL-
LOWS:
534G. Nothing contained in Sections 492, 521 and 522 of this Article,
amended from time to time, shall be applicable within Montgomery
County.
534 H. In Montgomery County
(a) IN MONTGOMERY COUNTY, except as specifically in this
Section otherwise provided, it is unlawful on Sunday for any whole-
sale or retail establishment to conduct business for labor or profit
in the usual manner and location or to operate its establishment in
any manner for the general public. It shall not cause, drect,
DIRECT, PERMIT, or authorize any employee or agent to engage
in or conduct business on its behalf on Sunday.
(b) Notwithstanding any provision of this section, the operation
of any of the following types of retail establishments is allowed on
Sunday:
1. Drug stores whose principal business is the sale of drugs and
related items.
2. Delicatessens whose principal business is the sale of delicates-
sens and related food items.
3. Bakeries and bake shops.
4. Gasoline stations whose principal business is the sale of gasoline,
oil, and other automobile maintenance items.
(c) Nothing in this section applies to:
1. Farmers
2. Nurserymen
3. Small business with not more than three (3) persons on any
