GOVERNING BODY MAY REQUIRE SUBSTANTIATION AND
ADDITIONAL INFORMATION WHEREVER THE COUNTY
GOVERNING BODY SHALL DETERMINE IT NECESSARY.
(c) Removal for cause. A county governing body may remove for
cause, prior to the expiration of the term for which a Commission
member was appointed, any member of the Commission appointed by
that county governing body. In such a case, the cause for removal
shall be stated in writing and a public hearing held thereon. At
such a hearing an opportunity shall be given to the Commission
member in question to present a defense in his or her own behalf.
Any vacancy occurring in the membership of the Commission for
any reason shall be filled as provided in this section for the unexpired
portion of the term.
[From the effective date of this Act, as the term of each present
member of the Commission from Prince George's County expires,
or as any vacancy may occur in a Commission membership from
Prince George's County, the new Commission members or member
from that County shall be appointed solely by the Board of County
Commissioners for Prince George's County. Subsequent to July 1,
1967, appointments shall be made so that, upon such appointee taking
office, not more than two members from Prince George's County shall
be of the same political party. From June 1, 1965, and thereafter,
as the term of each present Montgomery County Commissioner ex-
pires, or as the commission membership becomes vacant of commis-
sioners from Montgomery County, the three new commission mem-
bers, or member, from Montgomery County shall be appointed solely
by the County Council for Montgomery County, and subsequently,
such right to appoint in Montgomery County three of the commis-
sion members shall be and continue solely within the power of the
County Council for Montgomery County. Of the appointments of
Montgomery County, not more than two in the county shall be mem-
bers of the same political party. In Montgomery County, the County
Council shall be required to select their respective appointments or
re-appointments from a list of applicants. Said list shall be open to
the public at all times and shall be completed at least three weeks
prior to actual appointment or reappointment. In the event the
County Council does not appoint any individual whose name appears
on said list, or in the event that no name appears on said list, the
County Council shall provide for the preparation of a second list and
shall follow the procedure applicable to the first said list. All such
appointments or reappointments by the County Council shall be sub-
ject to Section 71-6 of the 1965 Montgomery County Code. No person
shall be appointed or continue in office as a member of said commis-
sion who holds any position of profit or trust under the Constitution
or laws of this state, or any political subdivision thereof, all ap-
pointees shall be residents and taxpayers of said Sanitary District
and shall serve for four years, or in the case of members from Mont-
gomery County only until their successors are appointed and have
qualified. The County Council for Montgomery County and the
Board of County Commissioners for Prince George's County may
remove for cause any respective member of the Commission ap-
pointed by said Council or board prior to the expiration of the term
for which he or she was appointed. In such a case, the cause for
removal shall be stated in writing and a public hearing held thereon.
At such a hearing an opportunity shall be given to the Commission
