tated Code of Maryland and all other provisions included in such
sections, including the penalty and license provisions, not herein
made inconsistent, shall remain in full force and effect.
258.
ON-PREMISE ADVERTISING SHALL BE PERMITTED ON
THE INTERSTATE AND EXPRESSWAY HIGHWAY SYSTEMS
OF THE STATE IN ACCORDANCE WITH THE PROVISIONS
OF LOCAL ZONING LAWS OR ORDINANCES WHICH ARE IN
EFFECT IN THE POLITICAL SUBDIVISIONS THROUGH
WHICH THE HIGHWAY TRAVERSES, PROVIDED SUCH
LOCAL ZONING LAWS OR ORDINANCES EMBRACE AND
REGULATE OUTDOOR ADVERTISING. IN AREAS WHERE
NO LOCAL ZONING LAWS OR ORDINANCES ARE IN EFFECT
AND IN THOSE AREAS WHERE THE LOCAL ZONING LAWS
OR ORDINANCES DO NOT EMBRACE OUTDOOR ADVERTIS-
ING, THE STATE ROADS COMMISSION IS AUTHORIZED TO
PROMULGATE AND ADOPT RULES AND REGULATIONS
GOVERNING ON-PREMISE OUTDOOR ADVERTISING SIGNS
ALONG THE INTERSTATE AND EXPRESSWAY HIGHWAY
SYSTEMS. SUCH RULES AND REGULATIONS SHALL BE
PROMULGATED AND ADOPTED IN ACCORDANCE WITH
THE PROVISIONS OF SECTION 255 OF THIS ACT. IN AREAS
NOT NOW COVERED BY APPROPRIATE ZONING LAWS OR
ORDINANCES AND WHICH MAY HEREAFTER ADOPT ZON-
ING LAWS OR ORDINANCES RELATING TO OUTDOOR AD-
VERTISING, SUCH LOCAL ZONING SHALL PREVAIL.
259.
OTHER THAN THE ON-PREMISE REGULATIONS PRO-
VIDED IN SECTION 258 OF THIS ACT, ON-PREMISE ADVER-
TISING IS NOT COVERED BY THIS ACT.
258. 260. Funding Authorization:
The State Roads Commission shall not expend any funds to con-
trol outdoor advertising pursuant to the Highway Beautification Act
of 1965 until appropriate matching Federal funds are available under
such Act.
259. 261. Liberal Construction:
This Act is to be liberally construed so as to carry out the intents
and purposes of the Act as set forth in its preamble and in the
Declaration of Policy herein.
260. 262. Severability:
If any clause, section, or provision of this subtitle shall be held
unconstitutional or invalid, such determination shall not be held to
affect any other clause, section, or provision hereof.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1968.
