fore issued or heretofore authorized by resolution of the Board of
Public Works to be issued and the governing bodies of each of the
counties and Baltimore City shall forthwith levy and collect such tax
at such rate. All matters committed by this Act to the discretion of
the Board of Public Works shall be determined by a majority of said
Board.

Sec. 7. And be it further enacted, That this Act shall take effect
July 1, 1968.

CHAPTER 586
(Senate Bill 490)

AN ACT to add new Section 349A to Article 27 of the Annotated
Code of Maryland (1957 Edition, 1967 Replacement Volume), title
"Crimes and Punishments," subtitle "Larceny—Horses or Ve-
hicles," to follow immediately after Section 349 thereof, to make
it unlawful for any person to possess motor vehicle master keys
or similar devices which are capable of being used to open or
operate motor vehicles, with certain exceptions and providing pen-
alties for violation of said Act.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 349A be added to Article 27 of the Annotated Code
of Maryland (1957 Edition, 1967 Replacement Volume), title "Crimes
and Punishments," subtitle "Larceny—Horses or Vehicles," to follow
immediately after Section 349 thereof, and to read as follows:

349A.

No person, except A PERSON WHILE MAKING LAWFUL USE
OF THEM IN PURSUIT OF A LEGITIMATE BUSINESS IN-
TEREST OR a law enforcement officer while in pursuit of his duties,
shall at any time have or possess a motor vehicle master key
or any
similar instrument or implement adapted for or capable of being
used to open or operate any motor vehicle in this State.

Any person who violates the provisions of this section, shall be
guilty of a felony
MISDEMEANOR and upon conviction shall be
fined not more than One Thousand Dollars ($1,000.00)
FIVE HUN-
DRED DOLLARS ($500) and/or shall be imprisoned for not more
than
three (3) years ONE (1) YEAR.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1968.
