75.
Any person doing business in this State as a well driller shall
comply with the applicable provisions of this subtitle.
76.
For purposes of this subtitle:
A "well" is any penetration in the ground whether drilled, bored,
cored or dug for water, gas, or oil, or any exploration for water. ,
gas, or oil.
A "well driller" is a person in responsible charge of the actual
drilling, boring, coring or digging or construction, alteration or
repair of any well. "Supervision" shall not be construed to require
the constant presence of or attendance of a well driller at any job
sites at any particular times during the operation.
The "Board" is the Maryland State Board of Well Drillers.
The "business of well drilling" includes the construction, altera-
tion or repair of a water well and related equipment necessary to
draw and purify water from the drilled well, including water pump,
tank and/or water conditioning equipment.
77.
(a) No license or authority other than as is issued or permitted
pursuant to this subtitle shall authorize any person to engage in
business in this State as a well driller. No county or city of this State
may require that any person obtain an authorization or license to do
business as a well driller in such county or city; provided, however,
that nothing in this subtitle shall be construed to deny any county
or city or other agency of this State or any political subdivision right
to adopt and enforce ordinances, rules, and regulations with respect
to wells or to the use of water.
(b) Nothing in this subtitle shall be construed to require a well
driller's license for a registered master plumber in connection with
the installation or repair of a pump, tank and/or water conditioning
equipment.
(c) This subtitle shall not apply to drive point wells and hand dug
wells.
78.
(a) There is hereby created the Maryland State Board of Well
Drillers.
(b) The Board shall be comprised of seven (7) members appointed
by the Governor for terms of two (2) years with the advice and con-
sent of the Senate. Of the seven appointments, one shall represent
the Eastern Shore which shall comprise the counties of Caroline,
Cecil, Dorchester, Kent, Queen Anne's, Somerset, Talbot, Wicomico
and Worcester; one shall represent Central Maryland which shall
comprise the counties of Baltimore, Carroll, Harford, Howard and
Montgomery and Baltimore City; one shall represent Southern Mary-
land which shall comprise the counties of Anne Arundel, Calvert,
Charles, Prince George's, and St. Mary's; and one shall represent
