and the inspection of certain classes of motor vehicles as provided
elsewhere in this Code. The Department shall perform such other
duties as may be assigned from time to time by the General
Assembly.

Management of Department
14. Superintendent.

(a)  Generally. The affairs and operations of the Department
shall be supervised and directed by a Superintendent.

(b)  Qualifications and appointment. The Superintendent shall be
appointed by the Governor by and with the advice and consent of
the Senate. The person so appointed must be a citizen of the United
States, a resident and voter of the State of Maryland, and qualified
on the basis of training, experience, and ability to discharge the
duties of the Superintendent.

(c)   Term. The Superintendent shall be appointed during the
regular session of the General Assembly next following each election
for Governor. His term shall begin on the first day of June following
such appointment and be for a term of four years. Upon the death,
resignation or removal of the Superintendent, the Governor shall
appoint a qualified person to serve for the remainder of the unexpired
term. A Superintendent may be removed by the Governor for official
misconduct or incompetence.

15. Powers of Superintendent.

(a)  Generally. The Superintendent shall have the power to make
any rules necessary to promote the effective and efficient performance
of the duties of the Department and to insure the good government
of the Department and its employees.

(b)  Enumeration of special powers. In supervising and direct-
ing the affairs of the Department and in exercising the powers re-
ferred to in the preceding subsection, the authority of the Superin-
tendent shall include, but shall not be limited to, the powers:

(1)   To determine and establish the form of organization of the
Department;

(2)   To create subordinate organizational subdivisions within the
Department; to determine and define the functions, duties, and re-
sponsibilities of each such organizational subdivision; and, from
time to time, to reclassify and redefine the functions, duties, and
responsibilities of any departmental subdivision, whether created by
the Superintendent or by law;

(3)  To assign and reassign, allocate and reallocate, employees of
the Department to such duties, organizational subdivisions, and
regional facilities of the Department as in his judgment may be
necessary to best serve the needs of the Department and the public
interest;

(4) To establish standards, qualifications, and prerequisites of
character, training, education, and experience for all employees;

(5) To determine and establish such ranks and grades and, in
accordance with the Merit System, such civilian classifications as
he may deem necessary and appropriate;
