110D.

All objects and materials of historical or archaeological value or
interest found on archaeological sites or any land owned or con-
trolled by the State are the property of the State and shall be
deposited for permanent preservation in a reputable museum or
institution of higher education or another recognized scientific or
historical institution or society.

110E.

In order to protect and preserve historical, archaeological and
scientific information, matters and objects which from time to time
may be found on privately owned lands in this State, the General
Assembly declares as a statement of legislative intent that such
excavations on privately owned lands should be discouraged except
in accordance with and pursuant to the spirit and authority of this
subtitle. Persons having knowledge of the location of archaeological
sites in the State of Maryland are encouraged to communicate such
information to a reputable museum, an institution of higher educa-
tion, a recognized scientific or historical institution or society, or
both, or the Maryland Geological Survey.

110F.

Any person who violates any of the prohibitory provisions of this
subheading is guilty of a misdemeanor. Upon conviction thereof,
he shall be fined a maximum of $100.00 or imprisoned for a maxi-
mum of thirty days, or subject to both such fine and imprisonment
in the discretion of the court. Each day of excavation, appropriation,
or act of injuring or destroying any archaeological site is a separate
offense and shall be punishable as such.

110G.

A Division of Archaeology is created within the Maryland Geo-
logical Survey. The administrative head of the Division shall be
the State Archaeologist who shall be a professional archaeologist
appointed by the Commission of the Maryland Geological Survey
in accordance with the Merit System Law. The Commission shall
appoint, in accordance with the Merit System Law, such assistants
and other employees as may be provided for in the budget.

110H.

There is hereby created a standing advisory committee which shall
be known as the Advisory Committee on Archaeology. The Com-
mittee shall consist of five members with skill and knowledge in
archaeological matters including representatives of reputable mu-
seums, institutions of higher education and recognized scientific
and/or historical societies or institutions. All members of the Com-
mittee shall be appointed by the Commission for an indefinite term.
Vacancies shall be filled by the Commission as in the original
appointment. A chairman shall be chosen by the Committee mem-
bers. The Committee members shall serve without compensation
other than reimbursement for travel and actual expenses incurred
in their duties under this subheading. These expenses will be
provided for in the budget of the Maryland Geological Survey. The
Chairman shall call the meetings which shall be held at least four
