CHAPTER 408
(Senate Bill 16)

AN ACT to repeal and re-enact, with amendments, Section 468 of
Article 27 of the Annotated Code of Maryland (1966 Supplement),
title and subtitle "Crimes and Punishments," subheading
"Refuse—Throwing or Dumping; Dumps, Junk Yards, Etc." to ex-
clude the throwing of trash, junk or refuse on public highways and
waters from the prohibitions against throwing such matter on the
property of others without consent.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 468 of Article 27 of the Annotated Code of Maryland
(1966 Supplement), title and subtitle "Crimes and Punishments,"
subheading "Refuse—Throwing or Dumping; Dumps, Junk Yards,
Etc." be and it is hereby repealed and re-enacted, with amendments,
to read as follows:

468.

It is unlawful for any person to throw, dump, deposit or leave any
trash, junk or other refuse upon the land or property of another
without the written consent having first been obtained from the
owner or unless the act is done under the personal direction of said
owner. And it is unlawful for any person to throw, dump, or deposit
any trash, junk or other refuse upon any public property, including
but not limited to, [public highways,] buildings, beaches, and
parks [, and waters].

Violation of this section is a misdemeanor and any person con-
victed thereof before a justice of the peace or court of proper juris-
diction is punishable by a fine of not less than $5.00 nor more than
$250.00, or by imprisonment of not less than thirty (30) nor more
than ninety (90) days, or both.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1967.

and (e) of Article 66˝ of the Annotated Code of Maryland (1957
