LAWS OF MARYLAND                      [CH. 396

(a)    Each member of the Board shall:

(1)    be a citizen of the United States and a resident of Maryland;

(2)    take and file with the proper state authority the oath pre-
scribed by Art. I, Sec. 6 of the Maryland Constitution before begin-
ning his or her term of office;

(3)    be a licensed professional nurse under this subtitle;

(4) have had at least five years' successful experience in nursing
administration or nursing education and have been actively engaged
in either of them for at least three years immediately preceding
appointment or reappointment.

(b)    At least four of the five Board Members shall have been
graduated from an accredited college with a baccalaureate or higher
degree in nursing or in education.

294.

(a) The Board shall have the following powers and duties:

(1)    To adopt and, from time to time, revise such rules and regu-
lations not inconsistent with the law, as may be necessary to enable
it to carry into effect the provisions of this subtitle.

(2)     To prescribe standards for educational programs preparing
persons for licensure under this subtitle.

(3)     To provide for surveys of such programs at such times as it
may deem necessary.

(4) To maintain a current list of institutions whose programs
meet the requirements of this subtitle and of the Board.

(5)     To examine, license, and renew the licenses of qualified ap-
plicants.

(6)    To conduct hearings upon charges calling for discipline of a
licensee or denial, revocation or suspension of a license.

(7)    To cause the prosecution of all persons violating this sub-
title and to have power to incur necessary expenses therefor.

(8)    To keep records of all of its proceedings.                           

(9)     To make an annual report to the Governor.

(10)     To appoint and employ such persons as may be necessary to
carry on the work of the Board.

(11)     To define the duties of its employees.

(12)     To set the amounts of and classify from time to time regis-
tration fees and fees for renewal of licenses, which fees shall be set
forth in the regulations and which shall be reasonably related to the
costs of administering this subtitle.

(13)     To limit by regulation the number of re-examinations which
may be taken by an applicant after failure, except that applicants
under Section 296(d) of this article shall have the privilege of at
lease LEAST one re-examination after the first failure.

(14)    To promulgate rules authorizing practice of professional
nursing or practical nursing, as the case may be, under such limita-
tions and professional supervision as the Board may require, by
otherwise qualified persons who are temporarily in this State or
