practice or offer to practice professional nursing or practical nursing,
or to use any sign, card or device to indicate that such person is a
professional nurse, a registered nurse or a practical nurse.

291.

As used in this subtitle the following terms shall have the meanings
indicated unless a contrary meaning is clearly intended from the
context in which the term appears:

(a)    "Board" means the State Board of Examiners of Nurses.

(b)    "Practice of professional nursing" means the performance
for compensation of any acts in the observation, care and counsel of
the ill, injured or infirm, or in the maintenance of health or preven-
tion of illness of others, or in the supervision and teaching of other
personnel, or the administration of medications and treatments-; as
prescribed by a licensed physician or dentist; requiring substantial
specialized judgment and skill and based on knowledge and applica-
tion of the principles of biological, physical and social science. The
foregoing shall not be deemed to include acts of diagnosis or prescrip-
tion of therapeutic or corrective measures.

(c)    "Practice of practical nursing" means the performance for
compensation of acts in the care of the ill, injured or infirm under

the direction of a registered professional nurse or a licensed phy-
sician or dentist, and not requiring the substantial specialized skill,
judgment, and knowledge required in professional nursing.

(d)    Nothing herein shall be deemed to prevent an unlicensed
person from performing acts of nursing, pursuant to the instruc-
tion and under the direction of a licensed physician, dentist, regis-
tered professional nurse, or licensed practical nurse within their
respective areas of responsibility. From and after June 1, 1969,
persons performing such selected acts shall not be designated by the
word "nurse," but may use the term "nursing," in connection with a
word to distinguish the occupation of the user, including but not
limited to, "nursing aide," "nursing assistant."

292.

(a)    The Governor shall appoint the Board consisting of five mem-
bers. The members of the Board holding office on June 1, 1967, shall
serve the balance of the terms for which they were appointed.
Thereafter the term of office for members of the Board shall be
three years. No member shall be appointed to more than three
consecutive terms.

(b)    On expiration of the term of any Board member, the Mary-
land Nurses Association shall submit to the Governor a list of five of
its members qualified to serve on the Board. Appointment shall be
made from this list. Vacancies occurring on the Board shall be filled
for the unexpired terms by the Governor in the manner aforesaid.
An additional list of five names shall be furnished to the Governor
by the Maryland Nurses Association upon his request.

(c)    The Governor may, after notice and an opportunity for hear-
ing, remove any member from the Board for neglect of any duty
required by law or for incompetency or unprofessional or dishon-
orable conduct.
