dollars ($15,000) the said orphans' court shall not proceed to order
said sales; provided, however, that such limitation shall not apply to
the orphans' court for Montgomery County.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1967.

CHAPTER 303
(House Bill 840)

AN ACT to repeal and re-enact, with amendments, Sections 190 (a)
and 190 (c) of Article 77 of the Annotated Code of Maryland (1965
Replacement Volume), title "Public Education," subtitle "Chapter
16. Public Libraries," permitting professional and clerical em-
ployees of the public libraries of Montgomery County to transfer
to the County retirement system and subsequently other qualified
retirement systems, and providing for continuance of contribu-
tions by the State of Maryland and transfer of contributions by
Montgomery County.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 190(a) and (c) of Article 77 of the Annotated Code
of Maryland (1965 Replacement Volume), title "Public Education,"
subtitle "Chapter 16. Public Libraries," be and they are hereby
repealed and re-enacted, with amendments, to read as follows:

190.

(a) The professional and clerical employees of any library estab-
lished or operating under the provisions of this subtitle shall be
included in the definition of "teacher" and "member," as said terms
are defined respectively in subsections (3) and (4) of Section 108
of this article, and all such professional and clerical employees shall
be entitled to all the rights and privileges and subject to all of the
obligations of the Teachers' Retirement System as established and
maintained under Sections 108 to 129, inclusive of this article; pro-
vided however, that each professional and clerical employee of the
department of public libraries of Montgomery County may elect to
transfer to the Employees' Retirement System of Montgomery
County; and any such employee may elect to subsequently transfer to
the Employees' Retirement System of the State of Maryland, other
State retirement system, or the retirement system of a municipality or
legislative body of the State of Maryland which is being operated
on an actuarial basis with contributions being made during the
active service of new members which are computed to be sufficient
to provide the reserves needed to cover the retirement benefits pay-
able on their account.

(c) Notwithstanding any other provision of this article or other
statute, the State of Maryland shall make contributions to the Re-
tirement and Pension System, and contributions for the employer's
share for social security, for the benefit of the professional and
