CHAPTER 265
(House Bill 602)

AN ACT to add a new Section 32-19 to the Code of Public Local
Laws of Prince George's County (1963 Edition, as amended, being
Article 17 of the Code of Public Local Laws of Maryland), title
"Prince George's County," subtitle "Fire Companies," TO FOL-
LOW IMMEDIATELY AFTER SECTION 32-18 THEREOF,
AS LAST AMENDED BY CHAPTER 745 OF THE ACTS OF
1966; providing that the Board of County Commissioners for
Prince George's County may by resolution provide that the appro-
priate fiscal officer of the County, before disbursing any fire taxes
levied pursuant to such subtitle, may withold a sufficient amount
from those fire taxes to be disbursed to any fire company to provide
for the payment of the principal of and interest on bonds issued by
the County to finance the construction of a fire engine house or
fire engine houses for such fire company.

Section 1. Be it enacted by the General Assembly of Maryland,
That a new Section 32-19 be and the same is hereby added to the
Code of Public Local Laws of Prince George's County (1963 Edition,
as amended, being Article 17 of the Code of Public Local Laws of
Maryland), TITLE "PRINCE GEORGE'S COUNTY," SUBTITLE
"FIRE COMPANIES," TO FOLLOW IMMEDIATELY AFTER
SECTION 32-18 THEREOF, AS LAST AMENDED BY CHAP-
TER 745 OF THE ACTS OF 1966, to read as follows:

32-19.

(a)    Notwithstanding any other provision of this subtitle 32, the
Board of County Commissioners for Prince George's County is
hereby authorized to direct the appropriate fiscal officer of Prince
George's County, before disbursing any taxes collected pursuant to
this subtitle 32 to any fire company in Prince George's County, to
withhold from such distribution an amount sufficient to provide for
the payment of the principal of and interest on any bonds issued
by the County for the purpose of providing funds for the con-
struction of a fire engine house or fire engine houses in Prince
George's County, including the acquisition and development of sites
therefor, the architectural and engineering services incident thereto,
and the acquisition and installation of necessary permanent fur-
nishings, fixed permanent equipment and fire-fighting equipment
therefor. In determining the amount to be withheld, the Board of
County Commissioners for Prince George's County may adopt such
formula as it, in its discretion, shall deem equitable and just.

(b)    The Board of County Commissioners for Prince George's
County shall determine, among other things, the amount of the
bond proceeds expended in each of the fire districts as defined in
this subtitle 32, the amount of money required to service the bonds
issued therefor and the amount of tax revenues allocable to the said
fire district under any of the provisions contained in this subtitle 32,
but in no event shall the bond service requirement for expenditures
made in any fire district exceed the amount of tax revenues allo-
cable to such fire district as determined in accordance with the terms
and provisions of this subtitle.
