CHAPTER 214
(House Bill 187)

AN ACT to repeal and re-enact, with amendments, Section 313B
(a) of Article 27 of the Annotated Code of Maryland (1957 Edition
and 1966 Supplement), title "Crimes and Punishments," subtitle
"Health-Amphetamines," making it a felony for any person (with
the exception of certain manufacturers and wholesalers) to sell
or in any manner to dispense or deliver amphetamines without a
valid prescription.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 313B(a) of Article 27 of the Annotated Code of Mary-
land (1957 Edition and 1966 Supplement), title "Crimes and Punish-
ments," subtitle "Health-Amphetamines," be and it is hereby re-
pealed and re-enacted, with amendments, to read as follows:

313B.

(a) It shall be unlawful for any person (with the exception of
manufactures and wholesalers in the regular course of business)
to manufacture, produce, sell, [prescribe,] administer, dispense, DE-
LIVER, [for] compound, or in any manner deliver any amphetamine
for which a prescription is required, except: [where such is the reg-
ular course of the business, occupation, profession, employment or
duty of such person or] where such amphetamine was obtained by
the possessor upon the presentation of, or pursuant to, a valid pre-
scription.

(1)    BY MANUFACTURERS AND WHOLESALERS IN THE
REGULAR COURSE OF THEIR BUSINESS, OR

(2)    BY LICENSED PHARMACISTS IN THE REGULAR
COURSE OF THEIR BUSINESS AND UPON PRESENTATION
OF A PRESCRIPTION, OR

(3)    BY OR UNDER THE SUPERVISION OF A DULY LI-
CENSED PHYSICIAN IN THE NORMAL PRACTICE OF HIS
OR HER PROFESSION.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1967.

AN ACT to add new Section 313BA to Article 27 of the Annotated
Code of Maryland (1957 Edition and 1966 Supplement), title
"Crimes and Punishments," subtitle "Crimes and Punishments,"
subheading "Health—Amphetamines," to follow immediately
after Section 313B thereof, to create the offense of selling, ped-
dling or dispensing of amphetamines AND BARBITURATES to
