Section 1. Be it enacted by the General Assembly of Maryland,
That Section 83-96 of the Code of Public Local Laws of Prince
George's County (1963 Edition), being Article 17 of the Code of
Public Local Laws of Maryland, and Section 71-45 of the Montgomery
County Code (1965 Edition), being Article 16 of the Public Local
Laws of Maryland, both subtitled "Washington Suburban Sanitary
District," as the same were last repealed and re-enacted, with amend-
ments, by Chapter 637 of the Acts of 1966, be and they are hereby
repealed and re-enacted, with amendments, to read as follows:
83-96. [(73-78)] (71-45). Five year programs of major water and
sewer extensions.
(a) Adoption. The Commission is hereby directed to adopt on or
before October 1, 1967, five-year projected programs of major exten-
sions of sanitary sewer and water facilities which it contemplates
may be made in the following five fiscal year period in the Sanitary
District and in such other areas within Montgomery and Prince
George's County as the Commission may deem appropriate for in-
clusion within the Sanitary District within [the next five years]
that period, and to revise and bring the programs up to date on or
before every first day of October thereafter by [the addition thereto
of additional projects to be added to such extension programs, and
such] providing for a similar five fiscal year period. The programs
and annual revisions thereof shall set forth the fiscal year in which
the Commission contemplates the construction and estimated cost of
each project included therein[. Said] , and the Commission shall
thereafter adhere to and follow such programs for the extension of
its facilities and shall not construct any project prior to the fiscal year
in which it is scheduled in said program until and unless [said Com-
mission] the County Commissioners for Prince George's County, if
the project is to be constructed in Prince George's County, or the
County Council for Montgomery County if the project is to be con-
structed in that county, by resolution shall determine and declare that
for the immediate preservation of the public health and safety, it is
necessary to change the order of priority and to direct the extension
of such facilities without regard to the order of priority previously
established, and except as otherwise required by this section. The
programs to be adopted on or before October 1, 1967, and each annual
revision thereafter, shall be prepared, submitted and adopted as
hereinafter specified. As used herein, the term "five year programs"
or "five year program" includes the annual revisions, unless the con-
tent otherwise indicates.
(b) Content of Program. [In Montgomery County the proposed
programs] Each five year water and sewerage program shall [con-
tain] show the addition [,] of new projects and the deletion, modi-
fication, or rescheduling of previously approved projects [and such
programs, including the annual revisions thereof, shall set forth]
with the following information concerning each [proposed] such
project: (1) the estimated maximum diameter, length, and location
of water and sewer lines; (2) the capacity, and approximate location,
of pumping stations; (3) the maximum population which could be
served by each sewer construction item as it is proposed to be de-
signed; (4) the maximum area limits which could be served by
gravity systems for each sewerage system construction item and the
area which each such item is designed to serve, such areas to be set
