in the State, to require adoption of standards for emissions and
ambient air quality in the State, to provide for monitoring of air
pollution and enforcement of this Act by the State Health De-
partment, and to provide criminal penalties for violations.

MARYLAND (1965 REPLACEMENT VOLUME AND 1966
SUPPLEMENT), TITLE "HEALTH", SUBTITLE "AIR POL-
LUTION" AND TO ENACT NEW SECTIONS 690 THROUGH
704, INCLUSIVE, IN LIEU THEREOF, TO STAND IN THE
PLACE OF THE SECTIONS SO REPEALED AND TO BE
UNDER THE NEW SUBTITLE "AIR QUALITY CONTROL",
TO REPEAL LAWS RELATING TO THE REGULATION OF
AIR POLLUTION AND TO VEST IN THE GOVERNOR OF
MARYLAND, THE STATE BOARD OF HEALTH AND MEN-
TAL HYGIENE AND THE STATE DEPARTMENT OF
HEALTH CERTAIN POWERS AND DUTIES OVER AIR POL-
LUTION IN THE STATE, TO ESTABLISH AIR POLLUTION
AREAS IN THE STATE, TO ESTABLISH AN AIR QUALITY
CONTROL ADVISORY COUNCIL, TO REQUIRE ADOPTION
OF STANDARDS FOR EMISSIONS AND AMBIENT AIR
QUALITY IN THE STATE, TO PROVIDE FOR MONITORING
OF AIR POLLUTION AND ENFORCEMENT OF THIS ACT,
TO PROVIDE FOR THE DECLARATION OF AIR POLLUTION
EMERGENCIES AND TO PROVIDE CRIMINAL PENALTIES
FOR VIOLATIONS.
Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 690 through 706, inclusive, of Article 43 of the Anno-
tated Code of Maryland (1965 Replacement Volume and 1966 Sup-
plement), title "Health", subtitle "Air Pollution", be and they are
hereby repealed, and that new Sections 690 through 699, 704, inclu-
sive, be and they are hereby enacted in lieu thereof, to stand in the
place of the sections so repealed, to be under the new subtitle "Air
Quality Control", and all to read as follows:
690.
Air Quality Control
(a) It is hereby declared to be the policy of the State of Maryland
to maintain that degree of purity of the air resources of the State
which will protect the health, general welfare and property of the
people of the State.
(b) For this purpose the State Department of Health shall as-
sume responsibility for the jurisdiction over emissions into the air
and ambient air quality through a division of Air Quality Control
within the Department.

As used herein, the following terms shall mean:
(a) "Board" means the State Board of Health and Mental Hygiene.
(b) "Department" means the State Health Department.
