287. Definitions.

(a)  The term "junk" shall mean old or scrap copper, brass, rope,
rags, batteries, paper, trash, rubber debris, waste, iron, steel, and
other old or scrap ferrous or non-ferrous material, including junked,
dismantled, or wrecked automobiles, or parts thereof.

(b)  The term "automobile graveyard" shall mean an establish-
ment or place of business which is maintained, used, or operated for
storing, keeping, buying or selling wrecked, scrapped, ruined, or dis-
mantled motor vehicles or motor vehicle parts.

(c)  The term "junk yard" shall mean an establishment or place
or business which is maintained, operated, or used for storing, keep-
ing, buying or selling junk, or for the maintenance or operation of
an automobile graveyard, and the term shall include garbage dumps
and sanitary fills.

(D) "SCRAP METAL PROCESSING FACILITY" SHALL
MEAN AN ESTABLISHMENT HAVING FACILITIES FOR
PROCESSING IRON, STEEL OR NON-FERROUS SCRAP METAL
AND WHOSE PRINCIPAL PRODUCT IS SCRAP IRON, STEEL
OR NON-FERROUS SCRAP FOR SALE FOR REMELTING PUR-
POSES ONLY.

(d) (E) "Interstate System" means that portion of the national
system of Interstate and Defense Highways located within this State,
as officially designated, or as may be so designated hereafter, by the
State Roads Commission, and approved by the Secretary of Com-
merce or Transportation, pursuant to the provisions of Title 23,
United States Code, "Highways".

(e) (F) "Primary System" means that portion of connected main
highways, as officially designated, or as may be hereafter so desig-
nated, by the State Roads Commission in accordance with Section
7B of this Article, and approved by the Secretary of Commerce or
Transportation, pursuant to the provisions of Title 23, United States
Code, "Highways".

288. Rules and Regulations.

The State Roads Commission is hereby authorized to promulgate
rules and regulations governing the issuance of licenses for the
establishment, operation,
SCREENING, FENCING, and mainte-
nance of a junk yard coming within the exceptions contained in sub-
sections (a) through (d) of Section 241, consistent with
NECES-
SARY FOR the safety, welfare, and enjoyment of the traveling
public and the preservation and enhancement of scenic beauty as
may be necessary to carry out the policy of the State declared in this
Act, and consistent with the National Standards promulgated by
the Secretary of Commerce or Transportation, as the case may be,
pursuant to Title 23, United States Code, "Highways". The State
Roads Commission shall have the authority to promulgate rules and

regulations governing the location, planting, construction, and main-
tenance, including the materials used, in screening or fencing re
-
quired by this Act. The Commission may also adopt rules and regu-
lations relating to the burning of trash, junk or other material on or
in such junk yard.
