CHAPTER 673
(Senate Bill 331)

AN ACT to repeal and re-enact, with amendments, Section 114A of
Article 66½ of the Annotated Code of Maryland (1957 Edition
and 1966 Supplement), title "Motor Vehicles", subtitle "Point
System", to add a new provision to subsection (c) thereof pro-
viding for the mandatory re-examination, pursuant to Article 91
of said Code, of any person whose operator's or chauffeur's license
shall have been suspended or revoked pursuant to the provisions of
subsection (c) or (d) of Section 114A of said Article 66½.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 114A of Article 66½ of the Annotated Code of Mary-
land (1957 Edition and 1966 Supplement), title "Motor Vehicles",
subtitle "Point System", be and it is hereby repealed and re-enacted,
with amendments, to read as follows:

114A.

(a) In addition to, but not in substitution of, any other provi-
sions of this article, the Commissioner of Motor Vehicles, shall after
notice to the general public put into effect a point system for the
suspension or revocation of motor vehicle operators' and chauffeurs'
licenses issued under this article. Points shall be charged against a
licensee after conviction of violation of the motor vehicle laws of
this State, and for the purposes of this subtitle, a forfeiture of col-
lateral shall be considered as a conviction. Initial point values shall
be assessed as follows:

Any moving violation not listed below and not contributing

to an accident....................................................................................................... 1 point

Violations contributing to an accident................................................. 3 points

Speeding (exceeding the posted speed limits by ten miles

or more).................................................................................................................. 3 points

Reckless driving ...................................................................................................„..... 3 points

Failure to report an accident......................__............................................. 5 points

Permitting unlicensed operator to operate a motor vehicle... 4 points
Leaving after colliding:

No personal injury..................................................................................... 8 points

With personal injury...................................„..............................................12 points

Operating after suspension or revocation..................................__.....12 points

Obtaining or attempting to obtain a permit by misrepre-
sentation .............................................................................................................„.....12 points

Loaning or altering a permit.......................................................____12 points

Conviction for any homicide or assault committed by means

of an automobile..................................................................................................12 points

Driving under the influence of intoxicating liquor or nar-
cotic drugs .............................................................................................................12 points

Any felony involving use of an automobile..........................................12 points

Whenever conviction occurs on multiple charges based on offenses
alleged to have been committed at the same time or arising out of
circumstances simultaneous in time and place, points shall be
assessed against the person so convicted only on the charge which
has the highest point assessment and shall not be assessed with
respect to the remainder of such multiple charges.
