222.

If any county named in Section 220 of this subtitle shall hereafter
desire to take over and perform the construction, reconstruction and
maintenance of its county roads on its own behalf and for its own
account, the county commissioners thereof may make a written re-
quest therefor to the State Roads Commission. Such request shall be
made at least ninety days in advance of the beginning of the first
State fiscal year as to which the request is desired to take effect. If
the State Roads Commission shall find that such county has, or is
reasonably assured of obtaining adequate facilities for constructing,
reconstructing and maintaining roads, and that such county has, or
is reasonably assured of obtaining the services of a roads engineer
having a degree of civil engineering and experience in constructing
roads, or who has had at least ten years practical experience in con-
structing roads in a supervisory and executive capacity, then the
State Roads Commission shall by resolution relinquish and transfer
to the county the functions of constructing, reconstructing and main-
taining the county roads within that county. Such transfer shall
become effective on the first day of the first State fiscal year follow-
ing the request by the county, and thereafter the State Roads Com-
mission shall have no duties, responsibilities or authority with re-
spect to the construction, reconstruction and maintenance of the
county roads of the particular county affected other than as pre-
scribed by Section 36 of this article with respect to county roads in
general. [Notwithstanding the provisions of this section, as to
Charles County, the State Roads Commission shall undertake, carry
out and perform the construction, reconstruction and maintenance
of the county road system in said county as provided in Section 220
of this subtitle.]

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1967.

CHAPTER 638
(House Bill 1128)

AN ACT to add a new Section 22A to the Code of Public Local
Laws of Somerset County (1963 Edition, being Article 20 of the
Code of Public Local Laws of Maryland), title "Somerset County,"
subtitle "County Commissioners," to follow immediately after
Section 22 thereof, authorizing the Board of County Commissioners
of Somerset County to make certain payments to municipal cor-
porations in that county and relating generally to the amount,
terms, conditions and purposes of these payments.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 22A be and it is hereby added to the Code of
Public Local Laws of Somerset County (1963 Edition, being Article
20 of the Code of Public Local Laws of Maryland), title "Somerset
County," subtitle "County Commissioners," to follow immediately
after Section 22 thereof, and to read as follows:
