spectively immediately after Sections 20(1) and 21 (c) thereof,
to set the amount of costs in certain criminal and civil cases
filed with or tried by Trial Magistrates in Allegany County.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Sections 20(k) and 21 (d) be and are hereby added to
Article 36 of the Annotated Code of Maryland (1965 Replacement
Volume), title "Fees of Officers," subtitle "Justices of the Peace,"
to follow respectively immediately after Sections 20 (1) and 21 (c)
thereof, and to read as follows:

20.

(k) In Allegany County, notwithstanding any other provisions
of the section, a fee of five dollars ($5.00) shall be paid at the
time of filing any suit with any trial magistrate in the county,
which fee shall constitute the entire costs of the proceedings for
the constable and magistrate. Poundage fees as now allowed shall
be continued, and for each defendant named in any suit in excess
of two, an additional fee of one dollar and fifty cents ($1.50) shall
be added to the costs. In executing a warrant of restitution upon
a landlords complaint, a writ of replevin or a writ of fi fa attach-
ment upon a judgment, the plaintiff shall be required to pay the
magistrate the costs of executing the same, said costs to be added
to the judgment entered upon the suit. The entire amount of filing
fees shall be paid over monthly to the County Commissioners by
the magistrate to whom said fees were paid.

21.

(d) In Allegany County, notwithstanding any other provision
of this section, any defendant who shall be found guilty and ordered
as part of his punishment, to pay the costs, shall pay the sum of
five dollars ($5.00) for each criminal warrant which shall cover
the entire costs of the case. In those cases where a warrant charg-
ing assault, battery or assault and battery, or disorderly conduct
shall be dismissed before trial, the costs to the prosecuting witness
shall be three dollars ($3.00).

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1967.

(House Bill 535)

AN ACT to repeal and re-enact, with amendments, Sections 3 (a,
and (s) of Article 25 of the Annotated Code of Maryland (1966
Replacement Volume), title "County Commissioners," subtitle
"General Provisions," to grant to the Allegany County Commis-
sioners certain additional powers granted by law to county com-
missioners in nonchartered counties, and to revise other powers
previously granted to the Allegany County Commissioners to make
them conform to this Act.
