Sec. 2. And be it further enacted, That in the event any pros-
ecutions referred to in this section have been instituted on the
effective date of this Act, the prosecuting officer who instituted
the same may, in his discretion, desist from the continued prosecution
thereof if in his judgment he would not have prosecuted the same had
the language of the section been directory rather than mandatory.
Sec. 3. And be it further enacted, That this Act is hereby declared
to be an emergency measure necessary for the immediate preservation
of the public health and safety and having been passed by a yea and
nay vote supported by three-fifths of the members elected to each of
the two houses of the General Assembly, the same shall take effect
from the date of its passage.

(House Bill 521)
AN ACT to repeal and re-enact, with amendments, Section 120 (a)
of Article 2B of the Annotated Code of Maryland (1957 Edition),
title "Alcoholic Beverages," subtitle "Restrictions upon
Licensees," to revise the restrictions applicable in Allegany County
to the employment of minors by alcoholic beverage licensees.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 120 (a) of Article 2B of the Annotated Code of Maryland
(1957 Edition), title "Alcoholic Beverages," subtitle "Restrictions
upon Licensees," be and it is hereby repealed and re-enacted, with
amendments, to read as follows:
120.
(a) In Allegany County it shall be unlawful for any liquor
licensee under this article to employ any person under the age of
twenty-one years and for any other class of licensee to employ any
person under the age of eighteen years in the sale of alcoholic
beverages or in connection with the business thereof.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1967.
