tenance, development, and operation of the park systems in the
counties, as well as the debt service required by its outstanding bonds
or bonds issued in the future. The Commission shall expend or dis-
burse that proportion of said tax collected from Montgomery County
within Montgomery County and that proportion collected from
Prince George's County within Prince George's County.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1967.

AN ACT to repeal and re-enact, with amendments, Section 699(b)
of Article 66C of the Annotated Code of Maryland (1957 Edition
and 1966 Supplement), title "Natural Resources," subtitle "Oys-
ters and Clams," to delete the exception to the oyster cull law.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 699 (b) of Article 66C of the Annotated Code of Mary-
land (1957 Edition and 1966 Supplement), title "Natural Resources,"
subtitle "Oysters and Clams," be and it is hereby repealed and re-
enacted, with amendments, to read as follows:
699.
(b) It shall be unlawful for any person to have oysters in his
possession which contain more than five per cent (5%) of shells
and oysters less than three inches from hinge to mouth (whether
adhering to marketable oysters or not), which for the purpose of
this subtitle are declared to be unmerchantable oysters [, except
that those marketable oysters having small oysters less than one
inch in length from hinge to mouth adhering to them which cannot
be removed without destroying the small oyster, shall not be counted
in the five per cent (5%). It is the intention of the General Assembly
that shells of oysters to which small oysters less than one inch in
length are so closely attached that they cannot be removed with-
out destroying the small oyster shall be returned to the tidal waters
of this State after shucking, to the greatest extent practicable and
with the least practicable delay, and the Department of Chesapeake
Bay Affairs is charged with the duty of carrying out the intent of
the General Assembly]. In ascertaining such percentage the of-
ficers or employees of the Department of Chesapeake Bay Affairs
are hereby authorized and directed to select such amount of oysters
from any pile, hold, bin, house or place as they think proper and
to require the same to be culled and disposed of, as provided in
subsection (a) of this section; and any person violating any of the
provisions of this section shall be subject to the penalties and fines
as provided in Section 717 in precisely the same manner as if he
were a captain or master of a boat; and it shall be unlawful for
any person to transport, or attempt to transport, outside of this
