A SENATOR REPRESENTS MORE THAN ONE COUNTY THE
NUMBER OF SCHOLARSHIP UNITS SHALL BE DIVIDED AS
EQUALLY AS POSSIBLE AMONG THE QUALIFYING STU-
DENTS IN EACH OF THE COUNTIES COMPRISING THE SEN-
ATORIAL DISTRICT.

265. 264.

(a)  The designation of the recipients of any award to be made by
Senators and authorized by this subtitle shall be made by the Sena-
tors by July 1 of the year in which the appointment is to be made. In
the event any designation is not made by this time, the right to make
the award shall thereafter be exercised by the State Scholarship
Board.

(b)  The awards to be appointed by the State Scholarship Board
shall be made to recipients in accordance with the rank order stand-
ing of candidates on the competitive scholarship examination. Public
announcement of the recipients shall be made by the Board after it
has transmitted to each Senator the list of recipients of the awards
to be made by the Senators.

266. 265.

If no qualified applicant shall have been appointed to receive an
award to be granted according to the provisions of this subtitle, the
appointing authority concerned may, at his discretion, appoint to the
award a person who, at the time of the examination referred to in
Section 265
263 of this Article, resided in a senatorial district of the
State other than that for which the award is provided; provided that
this person must otherwise fulfill the requirements established for
appointment under the provisions of this subtitle. A person appointed
under terms of this Section shall be entitled to receive the award
only for one academic year, but shall not thereby be prevented from
receiving a subsequent appointment, according to the provisions of
this subtitle, which subsequent appointment shall be for a total of
not more than three academic years.

267. 266.

If the recipient of any award granted according to the provisions
of this subtitle, shall withdraw from the institution at which the
award is used, or shall otherwise cease to fulfill the requirements
entitling him to receive the award during the course of an academic
year, the State shall be entitled to receive from the institution a pro
rata refund according to the policy of the institution with respect to
refunds to students in the event of withdrawal. Such refund shall
be made to the State Scholarship Board, which shall immediately
notify the appointing authority concerned. The appointing authority
shall then be entitled to make an interim appointment, in accordance
with the provisions of this subtitle, except those requiring an ex-
amination; the person so appointed shall be entitled to receive the
unused portion of the award only for the remainder of that scholastic
year, but shall not thereby be prevented from receiving subsequent
appointments according to the provisions of this subtitle, including
those requiring an examination,
EXCEPT THAT HE SHALL NOT
BE REQUIRED TO TAKE AN EXAMINATION.
