tion—Titling", be and it is hereby repealed and that a new Section
81 (z) be and it is hereby enacted in lieu thereof, to stand in the
place of the section repealed, and all to read as follows:
2. (a)
(6a) Commercial Trailer: (i) All trailers and semi-trailers de-
signed and used for carrying freight or merchandise or (ii) all
trailers and semi-trailers used for carrying freight or merchandise
in the furtherance of any commercial enterprise.
(10) Dealer. The term "dealer," except where it is used in con-
junction with the words "used car" [or] , "used vehicle" or "trailer,"
shall denote and be applicable to, and only to, any of the following:
(A) A sales branch or agency of a manufacturer of motor vehicles
or commercial trailers; (B) a distributor of new motor vehicles or
commercial trailers who holds an unexpired appointment as such in
writing from the manufacturer of such vehicles; or (C) a dealer in
new motor vehicles or commercial trailers who holds an unexpired
appointment as such in writing from the manufacturer of such ve-
hicles or from an authorized distributor of such vehicles.
(27) Motor Vehicle. Every vehicle which is self-propelled except
vehicles operated exclusively upon rails or propelled by electric power
obtained from overhead wires, but not operated upon rails or tracks.
(A) The term "new motor vehicle" is defined to mean a motor
vehicle or a commercial trailer, the ownership of which is in a manu-
facturer, dealer, or distributor, registered under the provisions of
this article, and which has never been so used as to destroy its new-
ness or to convert it into or make it a used or secondhand vehicle as
these terms are commonly used or understood in trade or business.
(B) The term "used motor vehicle" or "second-hand motor vehicle"
for the purposes of this law shall be applicable to all motor vehicles
other than those defined herein as new.
(41) Registered Dealer. Every dealer [or] , used car dealer or
trailer dealer registered with the Department in accordance with
the provisions of this article.
(49A) SALESMAN: THE TERM "SALESMAN" MEANS ANY
PERSON WHO SELLS OR OFFERS TO SELL ANY MOTOR
VEHICLE OR TRAILER EXCEPT BOAT TRAILERS OR
THOSE TRAILERS NOT EXCEEDING FIFTEEN (15) FEET IN
LENGTH, OR SOLICITS OR OTHERWISE ENDEAVORS TO
PROCURE IN ANY MANNER THE SALES OF A MOTOR
VEHICLE ON BEHALF OF A DEALER OR HIMSELF, IF HE
IS ALSO A DEALER, WHETHER OR NOT SUCH INDIVIDUAL
IS LICENSED OR SUBJECT TO THE LICENSING REQUIRE-
MENTS OF THIS ARTICLE.
(63a) Trailer Dealer: Every person, firm or corporation actively
engaged in the business of buying, selling, or exchanging new, used
or second-hand house trailers, office trailers, camper trailers, travel
trailers, luggage trailers, utility trailers, pole trailers, and boat
trailers and any other types of trailers not defined elsewhere in this
article.
