longnose gar, American eel, sea lamprey, skate, sting ray, cow nosed
ray, toadfish, and sand shark.

The word "speargun" shall include any type of device used for
propelling a spear underwater as a means of taking fish.

The term "game fish" shall include striped bass, tautog, flounder,
and sea trout.

319B.

(a) Any person properly licensed may take rough fish while

submerged under water, in areas designated by the Game and Inland
Fish Commission, by use of a speargun and spear, and nothing in

this Article shall be construed to limit or otherwise make unlawful

this practice.

    (a) Any person may take game fish while submerged under-

water without the aid of a self contained underwater breathing

apparatus, in the waters around the inlet at Ocean City, Maryland,

and Assawoman Bay, at AND AT SUCH areas designated by the

Game and Inland Fish Commission, OR THE DEPARTMENT OF
CHESAPEAKE BAY AFFAIRS, by the use of a speargun and spear.

(A)    IT SHALL BE LAWFUL TO FISH WITH A SPEAR GUN
AND SPEAR IN THE WATERS OF THE STATE OF MARYLAND
SUBJECT TO THE SUPERVISION, REGULATIONS, AND CON-
TROL OF THE GAME AND INLAND FISH COMMISSION AND
DEPARTMENT OF CHESAPEAKE BAY AFFAIRS IN THEIR
RESPECTIVE JURISDICTIONS. A SPEAR GUN AS USED IN
THIS SECTION SHALL BE DEFINED AS ANY TYPE OF DE-
VICE USED FOR PROPELLING A SPEAR (RUBBER, SPRING,
OR PNEUMATIC PROPELLED) UNDERWATER AS A MEANS
OF TAKING FISH.

(B)    IT SHALL BE A MISDEMEANOR TO VIOLATE THE
PROVISIONS OF THIS SECTION, AND ANY PERSON SO CON-
VICTED OF SUCH VIOLATION SHALL BE FINED NOT LESS
THAN TWENTY-FIVE DOLLARS ($25.00) NOR MORE THAN
ONE HUNDRED DOLLARS ($100.00), AND MAY BE SEN-
TENCED TO THIRTY (30) DAYS IN JAIL, EITHER, OR BOTH.

(c) It shall be unlawful to kill or attempt to kill, or otherwise
injure any fish by the use of a speargun except as prescribed in sub-
sections (a) and (b)
SUBSECTION (A) of this section.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1966.
