and are effective therein.

Sec. 3 2. And be it further enacted, That, subject to the provisions
of Section 2 above, this Act shall take effect June 1, 1966.

CHAPTER 367
(House Bill 19)

AN ACT to add new Section 263(g) to Article 66C of the Annotated
Code of Maryland (1957 Edition and 1965 Supplement), title
"Natural Resources," subtitle "Fish and Fisheries," subheading
"Part 2. Tidal Waters—In General," to follow immediately after
Section 263(f) thereof, to authorize the Department of Chesa-
peake Bay Affairs by regulation to restrict or prohibit the taking
of rock fish (striped bass) in spawning areas during the spawning
season and to provide penalties for violations.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 263 (g) be and it is hereby added to Article 66C of
the Annotated Code of Maryland (1957 Edition and 1965 Supple-
ment) , title "Natural Resources," subtitle "Fish and Fisheries," sub-
heading "Part 2. Tidal Waters—In General," to follow immediately
after Section 263(f) thereof, and to read as follows:

263.

(g) (1) The Department of Chesapeake Bay Affairs is author-
ized to restrict or prohibit by regulation the taking or catching of
striped bass
FISH in those areas where striped bass spawn during
the spawning season of the species.

(2)    Any person or persons found guilty of fishing or taking fish
as prohibited under this subsection is guilty of a misdemeanor and
upon conviction thereof shall be fined not less than twenty-five dol-

lars ($25.00); plus five dollars ($5.00) for each fish found in his or

their possessions and shall stand committed in the Baltimore City
jail or to the County jail until such fines and costs are paid.

(3)    All such fish found in his or their possession shall be con-
fiscated and shall be disposed of as provided under the other pro-
visions of this article.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1966.
