(2) The Governor, in making an appointment, shall consider the
appointee's interest, knowledge and experience in the field of educa-
tion and shall give due regard to the geographical representation of
the members of the Board within the County. At any given time,

there shall be at least one (1) female Board member and at least

two (2) members an who are SHALL BE of the political party opposite
of that to which the Governor is affiliated. No person shall be ap-
pointed for more than two successive terms as a member of said
Board.

(b) Except as otherwise provided in this section, the provisions
of Section 6 of this Article shall apply to the Board of Education of
Washington County.

Sec. 2. And be it further enacted, That this Act is hereby
declared to be an emergency measure and necessary for the imme-
diate preservation of the public health and safety and having been
passed by a yea and nay vote supported by three-fifths of all the
members elected to each of the two houses of the General Assembly,
the same shall take effect from the date of its passage.

CHAPTER 283
(Senate Bill 63)

AN ACT to repeal and re-enact, with amendments,

SECTIONS 37 (C) AND 52B of Article 2B of the Annotated Code
of Maryland (1957 Edition and 1965 Supplement), title "Alcoholic
Beverages", subtitles "Local Licenses and License Provisions",
AND "GENERAL PROVISIONS ON ISSUE OF LICENSES",
RESPECTIVELY, to provide that in Montgomery County it is
unlawful for any person, corporation, club or organization con-
ducting a profit making business on his or its premises or on
premises under his or its possession or control, if those premises

constitute a restaurant, tavern, hotel, club, place of public enter-

tainment or premises open to the public, to permit alcoholic bever-
ages to be kept on said premises.
WHERE THE MAJORITY
INTEREST OF A CORPORATION, CLUB OR ORGANIZATION
IS OWNED OR CONTROLLED BY THE SALARIED EM-
PLOYEES THEREOF, SUCH CORPORATION, CLUB OR OR-
GANIZATION SHALL BE DEEMED TO BE A PROFIT MAK-
ING BUSINESS FOR THE PURPOSE OF THIS SUBSECTION,
TO PROVIDE FOR THE EXAMINATION OF THE BOOKS
AND RECORDS OF CERTAIN BUSINESSES AND TO PRO-
VIDE FOR THE DEFINITION OF THE USE OF THE WORD
"SCHOOL" AND GRANTING TO THE BOARD OF LICENSE
COMMISSIONERS OF MONTGOMERY COUNTY DISCRETION
IN THE GRANTING OF ALCOHOLIC BEVERAGE LICENSES
IN CERTAIN AREAS WITHIN 750 FEET OF ANY ELEMEN-
TARY OR SECONDARY SCHOOL, CHURCH, OTHER
PLACE OF WORSHIP, PUBLIC LIBRARY, OR YOUTH CEN-
TER SPONSORED OR CONDUCTED BY ANY GOVERNMEN-
TAL AGENCY.
