CHAPTER 273
(Senate Bill 225)

AN ACT to repeal and re-enact, with amendments, Section 96 of
Article 2B of the Annotated Code of Maryland (1965 Supplement),
title "Alcoholic Beverages", subtitle "Hours and Days for Sale",
to revise the hours and days for sale of alcoholic beverages by
licensees in Charles County in order to clarify and make the law in
respect to hours and days of sale uniform.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 96 of Article 2B of the Annotated Code of Maryland
(1965 Supplement), title "Alcoholic Beverages", subtitle "Hours and
Days for Sale", be and it is hereby repealed and re-enacted, with
amendments, to read as follows:

96. [In Charles County, notwithstanding any other provisions of
this subtitle, it shall be unlawful for any licensee or any agent,
servant or employee of said licensee under this subtitle to sell liquors
on the Sabbath Day, commonly called Sunday, except that liquors
may be sold and consumed on Sunday beginning at 12 o'clock noon
until midnight on Sunday; nor shall any liquors be sold by any
licensee or any agent, servant or employee of said licensee between
the hours of 2 o'clock A.M. and 6 o'clock A.M. But this section shall
not prevent any sale of beer or light wine under a Class C license or
any other sale of wine or beer containing less than 20% alcohol by
volume on any day including Sunday, or at any time except between
the hours of 2 o'clock A.M. and 6 o'clock A.M. The barroom where
alcoholic beverages are sold or displayed shall be closed at 2 o'clock
A.M. and all bottles and containers used in dispensing alcoholic
beverages must be removed from the tables on or before this time.]
In Charles County, notwithstanding any other provisions of this sub-
title, the hours of sale for alcoholic beverages, on Monday through
Saturday, shall be from 6 o'clock A.M. until 2 o'clock A.M. on the
following day. On Sunday, the hours of sale for beer and wine shall
be from 6 o'clock A.M. to 12 o'clock midnight, and the hours of sale
for liquors shall be from 12 o'clock noon to 12 o'clock midnight. It is
unlawful for any licensee, his agent or employee, to sell any alcoholic
beverages on any day between the hours of 2 o'clock A.M. and
6 o'clock AM.
and THAT PART OF any premises where alcoholic
beverages are sold or displayed shall be closed at 2 o'clock A.M. and
in the case of any on-sale class of license, all bottles and containers
used in dispensing alcoholic beverages must be removed from the
tables on or before this time. It is unlawful to sell any liquors on
Sunday between the hours of 2 o'clock A.M. and 12 o'clock noon.
The
hours established in this section for the sale of alcoholic beverages
are hereby declared to be in accordance with Eastern Standard Time
whenever such time is in effect or in accordance with daylight time
whenever such time is in effect. Any person violating any of the
provisions of this section shall be deemed guilty of a misdemeanor
and upon trial and conviction shall be subjected to a fine of not less
than fifty dollars ($50.00) nor more than two hundred and fifty
dollars ($250.00), or may be confined in the county jail or in the
house of correction for not less than sixty days, or both, in the dis-
cretion of the court.
