CHAPTER 168
(Senate Bill. 479)

AN ACT to add a new Section 7A to Article 95 of the Annotated
Code of Maryland (1957 Edition), title "Treasurer", said new
section to follow immediately after Section 7 thereof, to provide
for the transfer of outstanding checks to an account on the Comp-
troller of the Treasury's records, known as "Unpresented Checks
Fund"; to provide a limit to accumulation of such funds and to
revert certain excesses to the General Funds of the State.

Section 1. Be it enacted by the General Assembly of Maryland,
That a new Section 7A be and it is hereby added to Article 95 of the
Annotated Code of Maryland (1957 Edition), title "Treasurer", said
new section to follow immediately after Section 7 thereof, and to read
as follows:

7A.

1.    The Treasurer of the State, at the end of each fiscal year, shall
determine the checks issued against the funds of the State which
have not been presented for payment within the two years prior to
the dates of determination.

2.    The Treasurer shall certify to the Comptroller of the Treasury
the date of issue, check number, bank drawn against, payee and
amount of such checks and request the Comptroller to warrant the
amount and account for same in an account entitled "Unpresented
Checks Fund."

3.    The Treasurer, at the end of each fiscal year, shall determine
the checks which have remained in the "Unpresented Checks Fund"
for a period of three years and shall secure from the Comptroller a
warrant transferring the amount, in excess of a minimum balance
as determined by the Treasurer, of such checks from the "Unpre-
sented Checks Fund" to the General Funds of the State, or when the
source of the funds is of a revolving or restricted nature, the amount
of such checks shall be returned to their source upon proper advice
of the agency involved.

4. Any checks presented for payment after having been war-
ranted into the "Unpresented Checks Fund" shall be reissued and
charged against the "Unpresented Checks Fund" by the Treasurer
upon warrant by the Comptroller.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1966.
