(m) (2) Outside Ocean City. Bona fide hotels having 20 or more
rooms regularly serving meals located outside the corporate limits
of Ocean City, and restaurants having a table seating capacity of
70 or more people located outside the corporate limits of Ocean City
shall make application to the board of license commissioners of
Worcester County for a license to serve beer, wine, or liquor; and
upon approval by the licensing authority and upon compliance with
the general provisions of this article, and payment to the board of
license commissioners of an annual fee of [$1,0003 $600 shall be en-
titled to a license which will permit said hotel or restaurant to serve
liquor, wines, or beer during the hours as provided in Section 106 of
this article. [Such licenses shall be issued only to persons who have
been registered voters and taxpayers of Worcester County for at
least 5 years prior to said application. Licenses shall be issued only
to individuals and not to any firm or corporation.] All of said
licensees shall purchase all liquors and wines from the liquor con-
trol board for Worcester County. No license shall be issued unless
said hotel or restaurant is operated in a clean and sanitary manner
and is equipped with proper rest-room facilities. All license fees
shall go to the general funds of the county except where the licensed
premises are in an incorporated town in which event one half of
the funds shall go to the incorporated town.

Sec. 2. And be it further enacted, That this Act is hereby de-
clared to be an emergency measure and necessary for the immediate
preservation of the public health and safety and having been passed
by a yea and nay vote supported by three-fifths of all the members
elected to each of the two houses of the General Assembly, the same
shall take effect from the date of its passage.

CHAPTER 144
(Senate Bill 80)

AN ACT to repeal and re-enact, with amendments, Section 264 (a)
of Article 27 of the Annotated Code of Maryland (1965 Supple-
ment), title "Crimes and Punishments", subtitle "Gaming", adding
Wicomico County to the list of the political subdivisions in which
certain money, currency, or cash seized or captured by a police
officer in connection with certain unlawful operations is deemed
prima facie to be contraband of law.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 264 (a) of Article 27 of the Annotated Code of Mary-
land (1965 Supplement), title "Crimes and Punishments", subtitle
"Gaming", be and it is hereby repealed and re-enacted, with amend-
ments, to read as follows:

264. (a) Whenever any money, currency or cash shall be seized
or captured by any police officer in Baltimore City, Allegany, Calvert,
Carroll, Cecil, Garrett, Harford, Howard, Kent, St. Mary's [and] ,
Washington and Wicomico counties in connection with any arrest for
