vide for appeals from the court to the Court of Appeals, and to
relate generally to the Court of Special Appeals.
Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 130, 131 and 132 130 AND 131 be and they are
hereby added to Article 26 of the Annotated Code of Maryland (1957
Edition and 1965 Supplement), title "Courts," to follow immediately
after Section 129 thereof, to be under the new subtitle "Court of
Special Appeals," and all to read as follows:
Court of Special Appeals
130.
The Court of Special Appeals THERE IS HEREBY CREATED
AN INTERMEDIATE COURT OF APPEAL, TO BE KNOWN AS
THE "COURT OF SPECIAL APPEALS" AND WHICH shall be
composed of five judges, one from the First Special Appellate Judicial
Circuit consisting of Harford, Cecil, Kent, Queen Anne's, Caroline,
Dorchester, Wicomico, Somerset, Worcester and Talbot Counties; one
from the Second Special Appellate Judicial Circuit consisting of Balti-
more, Carroll and Howard Counties; one from the Third Special Ap-
pellate Judicial Circuit consisting of Montgomery, Frederick, Wash-
ington, Allegany and Garrett Counties; one from the Fourth Special
Appellate Judicial Circuit consisting of Prince George's, Anne Arun-
del, Calvert, Charles and, St. Mary's Counties; and one from the Fifth
Special Appellate Judicial Circuit consisting of Baltimore City. The
Judges of the Court of Special Appeals shall be residents of and shall,
subject to the provisions of Section 5 of Article IV of the Constitution,
be elected by the qualified voters of their respective Special Appellate
Judicial Circuits, their terms to begin on the date of their qualifica-
tion,, One of the Judges of the Court of Special Appeals shall be
designated by the Governor as Chief Judge. The Court of Special
Appeals shall have appellate jurisdiction only which shall be co-
extensive with the limits of the State and which shall, unless and
until otherwise expressly changed by law, include direct appeals
from the Circuit Courts of the Counties and from the Criminal Court
of Baltimore City in all criminal cases where the sentence is other
than death, subject in each such case to a further appeal to the
Court of Appeals as provided by Section 2lA of Article 5 of this
Code, as amended from time to time. The Court of Special Appeals
shall hold its sessions in the City of Annapolis and at such time or
times as it shall from time to time by rule prescribe. Its session or
sessions shall continue not less than fen months in each year if the
business before it shall so require. The salary of each Judge of the
Court of Special Appeals shall be that prescribed in Section 47(a-1)
of this article and, shall not be diminished during his continuance in
office. Five THREE FOUR of the Judges shall constitute a quorum,
and all five judges shall sit for the decision of any cause THE CON-
CURRENCE OF A MAJORITY OF THOSE SITTINC THE EN-
TIRE COURT SHALL BE SUFFICIENT NECESSARY FOR THE
DECISION OF ANY CAUSE; PROVIDED, HOWEVER, THAT.
NOTHING HEREIN CONTAINED SHALL AUTHORIZE THE
COURT TO SIT IN ONE OR MORE PANELS OR DIVISIONS.

The General Assembly may from time to time provide by law for
additional Judges of the Court of Special Appeals and designate the
