CHAPTER 116
(House Bill 912)

AN ACT to repeal Section 38 (c) of Article 2-B of the Annotated
Code of Maryland (1957 Edition), title "Alcoholic Beverages,"
said section being headed "Prince George's County," subsection
(c) being headed "Riverdale," to remove REMOVING the
restriction for AGAINST the sale SELLING AT ANY PLACE,
or giving away of AT ANY PLACE OF BUSINESS any alcoholic
beverages or intoxicating liquor for consumption on the premises,
except beer and wine, in WITHIN the corporate limits of the
Town of Riverdale, , SUBJECT TO A REFERENDUM IN THE
TOWN OF RIVERDALE, DECLARING THIS ACT TO BE AN
EMERGENCY MEASURE AND SEVERABLE.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 38(c) of Article 2-B of the Annotated Code of Maryland
(1957 Edition), title "Alcoholic Beverages," said section being
headed "Prince George's County," subsection (c) being headed
"Riverdale," being BE AND the same is hereby repealed.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1966.
THAT BEFORE THIS ACT BECOMES EFFECTIVE,
IT SHALL FIRST BE SUBMITTED TO A REFERENDUM OF THE
LEGALLY QUALIFIED VOTERS OF THE TOWN OF RIVER-
DALE AT THE TOWN ELECTION TO BE HELD IN MAY, 1966.
THERE SHALL BE PRINTED ON THE BALLOTS OR BALLOT
LABELS TO BE USED AT SAID ELECTION, THE TITLE OF THIS
ACT AND UNDERNEATH SAID TITLE, ON SEPARATE LINES,
A SQUARE OR BOX TO THE RIGHT OF AND OPPOSITE THE
WORDS: "FOR REPEAL OF PROHIBITION OF CERTAIN AL-
COHOLIC BEVERAGES IN THE TOWN OF RIVERDALE" AND
A CORRESPONDING BOX OR SQUARE TO THE RIGHT OF
AND OPPOSITE THE WORDS "AGAINST REPEAL OF PRO-
HIBITION OF CERTAIN ALCOHOLIC BEVERAGES IN THE
TOWN OF RIVERDALE," SO THAT THE VOTERS OF THE
TOWN SHALL BE ABLE TO DESIGNATE HIS OR HER DECI-
SION FOR OR AGAINST THE PROVISIONS OF THIS ACT. IF
A MAJORITY OF THE VOTES CAST ON THE QUESTION IN
SAID ELECTION SHALL BE "FOR REPEAL OF PROHIBITION
OF CERTAIN ALCOHOLIC BEVERAGES IN THE TOWN OF
RIVERDALE" THEN THE PROVISIONS OF THIS ACT SHALL
BECOME EFFECTIVE, BUT IF A MAJORITY OF THE VOTES
CAST ON THE QUESTION IN SAID ELECTION SHALL BE
"AGAINST REPEAL OF PROHIBITION OF CERTAIN ALCO-
HOLIC BEVERAGES IN THE TOWN OF RIVERDALE," THEN
THE PROVISIONS OF THIS ACT SHALL BECOME OF NO EF-
FECT AND SHALL BE NULL AND VOID.

SECTION 3. AND BE IT FURTHER ENACTED, THAT IF
ANY WORD, PHRASE, CLAUSE, SENTENCE OR OTHER PART
OR PARTS OF THIS ACT SHALL BE HELD UNCONSTITU-
TIONAL BY ANY COURT OF COMPETENT JURISDICTION,
SUCH UNCONSTITUTIONALLY SHALL NOT AFFECT THE
VALIDITY OF THE REMAINING PARTS OF THIS ACT.
