Dear Mr. Speaker:
I have today vetoed House Bill 940 and, in accordance with
the provisions of Article 2, Section 17 of the Maryland Constitution,
I am returning the same to you along with my message concerning
this action.
Following the passage of this legislation through both houses
of the General Assembly, its sponsor, Honorable Elroy G. Boyer of
Kent County, contacted my office and requested that the matter be
vetoed. It was in compliance with his request that the veto action
was taken.

House Bill No. 1075—Teachers' Retirement System
AN ACT to add a new Section 110(5a) to Article 77 of the An-
notated Code of Maryland (1965 Replacement Volume), title "Public
Education," subtitle "Chapter 8. Teachers' Certificates, Salaries and
Pensions," subheading "Teachers' Retirement System," to follow im-
mediately after Section 110(5) thereof, amending the laws con-
cerning the Teachers' Retirement System in order to permit the
crediting of membership service, after the payment of certain ac-
cumulated contributions, for certain services as a teacher in a pri-
vate school performing public school functions, and relating gen-
erally to the terms and conditions for such membership service
credit.

In accordance with the provisions of Article 2, Section 17 of the
Maryland Constitution, I have today vetoed House Bill 1075.
This Bill would permit a teacher to receive credit in the State
Retirement System for certain private school service.
I have been advised by the Director of the Maryland State Re-
tirement System that the State System was established for public
