Senate Bill No. 341—Sales of Tobacco
AN ACT to repeal and re-enact, with amendments, Sections 44
through 48 of Article 48 of the Annotated Code of Maryland (1965
Replacement Volume), title "Inspections," subtitle "Tobacco," pro-
viding for reporting of sale or resale of tobacco in the State to be
made to the State Tobacco Authority rather than the State Board of
Agriculture and generally amending the laws as to forms, reports,
records and publication of reports to so conform, and to correct an
error therein AND TO REPEAL SECTION 59 (C) OF SAID AR-
TICLE AND TITLE, SUBTITLE "STATE TOBACCO AUTHOR-
ITY," AND ENACT NEW SECTIONS 59 (C), 59 (D), AND 59
(E) IN LIEU THEREOF TO STAND IN THE PLACE OF THE
SECTION SO REPEALED, AMENDING THE LAW REGARDING
RECORDS AND REPORTS OF SALES OF TOBACCO IN MARY-
LAND, PLACING AUTHORITY IN AND PROVIDING FOR RE-
PORTING OF SALE TO THE STATE TOBACCO AUTHORITY
RATHER THAN THE MARYLAND STATE BOARD OF AGRI-
CULTURE, AND DELETING CERTAIN REQUIREMENTS
THEREUNDER.

Dear Mr. President:
I have today vetoed Senate Bill 341 and, in accordance with
the provisions of Article 2, Section 17 of the Maryland Constitu-
tion, I am returning the same to you along with my message con-
cerning this action.
On May 4 of this year, I received a letter from the Attorney
General, a copy of which is attached and to be considered a part of
this message, advising that in the opinion of that office, the bill
was unconstitutional. In light of that advice, I felt that I could
not sign the same into law.
