(Senate Joint Resolution 44)
Senate Joint Resolution requesting the Legislative Council to study
the Federal Youth Correction Act to determine the advisability and
feasibility of the adoption of a similar program in Maryland.
Whereas, For a period in excess of fifteen years, the Federal Courts
have availed themselves of the provisions of Chapter 402, Title 18, of
the United States Code Annotated, "Federal Youth Correction Act"
in cases where a youth is convicted of a criminal violation carrying
with it a sentence of imprisonment; and
Whereas, The effective utilization of the Act in certain individual
cases has helped to mold a useful citizen of a youth who would other-
wise have served a sentence to most probably return to society a
hardened young adult; and
Whereas, It is necessary to provide the judiciary of the State of
Maryland with a similar vehicle to provide for an alternative to in-
carceration of youthful violators of the criminal laws of the State;
a vehicle to be used with discretion and caution by the courts in situ-
ations where the nature of the offense and character and stability
of the youthful offender warrant its use; now, therefore, be it
Resolved by the General Assembly of Maryland, That the Legislative
Council during the year 1966 is requested to add to its agenda the
study of the Federal Youth Correction Act, as contained in Chapter
402, Title 18, of the United States Code Annotated, to determine the
advisability of making available similar provisions in the courts of
this State; and be it further
Resolved, That the Legislative Council shall consult with the State's
Attorneys Association of Maryland, the Maryland Bar Association,
Parole and Probation Departments of the State, and such other agen-
cies and individuals as it deems necessary in making its determina-
tion; and be it further
Resolved, That the Legislative Council is requested to submit the
results of its study together with any recommendations to the General
Assembly of 1967.
