equal and matching fund for this project is not presented to the
Board of Public Works on or before June 1, [1967] 1968, no funds
under the provisions of this Act shall thereafter be paid over to or
expended for the purpose of aiding in the construction of a Science
Center for the Maryland Academy of Sciences.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1966.

CHAPTER 724
(House Bill 168)

AN ACT to add a new Section 94 to Article 100 of the Annotated
Code of Maryland (1964 Replacement Volume and 1965 Supple-
ment), title "Work, Labor and Employment," to be under the new-
subtitle "Lie Detector Tests," to follow immediately after Section
93 thereof, prohibiting employers from requiring any applicant
for employment, or any employee, to take a lie detector, polygraph
or similar test as a condition of employment or continued em-
ployment.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 94 be and it is hereby added to Article 100 of the
Annotated Code of Maryland (1964 Replacement Volume and 1965
Supplement), title "Work, Labor and Employment," to be under
the new subtitle "Lie Detector Tests," to follow immediately after
Section 93 thereof, and to read as follows:

94.

(a)    The term "employer" as used in this subtitle means every
employer engaged in any business or enterprise in this State, other
than the Government of the State of Maryland, or any county, in-
corporated city or town, or other municipal corporation.

(b)    No employer shall demand or require any applicant for
employment or prospective employment or any employee to submit
to or take a polygraph, lie detector or similar test or examination as
a condition of employment or continued employment. The prohibition
of this section does not apply to the federal government or any agency
thereof or the State Government or any agency or local subdivision
thereof, including, but not limited to, counties, city and counties,
cities, districts, authorities, and agencies.

(c)    Any employer who violates the provisions of this subtitle shall
be guilty of a misdemeanor and subject to a fine not to exceed one
hundred dollars ($100.00).

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1966.
