Board of Health and Mental Hygiene shall allow the State Depart-
ment of Public Welfare to provide foster care and the child welfare
services of said Department to the mentally retarded.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section IB of Article 43 of the Annotated Code of Maryland
(1965 Replacement Volume and 1965 Supplement), title "Health,"
subtitle "State Board of Health and Mental Hygiene," be and it is
hereby repealed and re-enacted, with amendments, to read as follows:

The State Board of Health and Mental Hygiene shall have care of
the health interests of the people of this State; shall provide in-
patient and outpatient facilities for the treatment and care of chron-
ically ill, mentally ill, tuberculous 'persons and mentally retarded
persons, and shall allow the State Department of Public Welfare to
provide foster care and the full range of child welfare services of said
Department to said mentally retarded persons; [and tuberculous
persons;] shall provide preventive services and medical hospital and
home-care programs for the indigent and medically indigent; and
shall establish policy for the State Department of Health and the
State Department of Mental Hygiene.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1966.

AN ACT to repeal and re-enact, with amendments, Sections 1, 4,
and 5 of Chapter 138 of the Laws of 1964, and to add new Section
7A to said Chapter 138 of the Laws of 1964, to follow immediately
after Section 7 thereof, and to add new Sections 568H and 5681 to
Article 43 of the Annotated Code of Maryland (1965 Replacement
Volume), title "Health," subtitle "Maryland Hospital Commis-
sion," providing that the Hospital Construction Loan of 1964
shall consist of two separate and distinct loan funds, one to be
used for loans to hospitals not affiliated with a church or religious
denomination, and the other to be used for hospitals so affiliated,
providing generally for such loans, declaring the severability of the
provisions of Chapter 138 of the Laws of 1964, and of Sections
568A through 568-I inclusive of Article 43 of the Annotated Code
of Maryland (1965 Replacement Volume), title "Health," sub-
title "Maryland Hospital Commission," and declaring this Act to
be an emergency measure; AND PROVIDING FOR A CERTAIN
CONTINGENCY WHEREBY THIS ACT MAY BE REPEALED
AND OF NO FURTHER EFFECT.
