diate preservation of the public health and safety, and having been
passed by a yea and nay vote supported by three-fifths of the mem-
bers elected to each of the two Houses of the General Assembly, the
same shall take effect from the date of its passage.

CHAPTER 8
(Senate Bill 129)

AN ACT to repeal and re-enact, with amendments, Sections 3 and
27 (a) of Article 64A of the Annotated Code of Maryland (1964
Replacement Volume and 1965 Supplement), title "Merit System",
and to repeal and re-enact, with amendments, Section 329 of Ar-
ticle 77 of the Annotated Code of Maryland (1965 Replacement
Volume) title "Public Education", sub-title "Teachers in Institu-
tions", providing that persons employed in certain institutions or
other agencies with teaching duties and responsibilities comparable
to those in the public school system, as determined by the State
Department of Education, shall receive an annual salary not less
than that received by public school teachers of similar training and
experience in the particular political subdivision in which located;
excluding teachers, principals, directors of education and super-
visors of vocational education on the staffs of Boys' Village of
Maryland, Maryland Training School for Boys, Montrose School
for Girls, Maryland Children's Centers, Victor Cullen School, and
any and all other institutions which are under the supervision,
direction, control and general management of the State Depart
ment of Public Welfare, from inclusion in State pay plans under
the jurisdiction of the State Standard Salary Board.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 3 and 27 (a) of Article 64A of the Annotated Code of
Maryland (1964 Replacement Volume and 1965 Supplement), title
"Merit System", be and they are hereby repealed and re-enacted,
with amendments, to read as follows:

3. Positions excluded from system—Enumeration.

The following positions shall not be included in the classified serv-
ice, namely: those held by officers elected by popular vote and officers
whose appointment and election is provided by the Constitution, in-
cluding deputy clerks provided for by the Constitution, Articles 4, 26
and 37; officers and employees of the General Assembly or of either
house thereof; deputies, assistants and employees appointed or desig-
nated by any sheriff, any register of wills, any clerk of court, any
State's attorney or any board of supervisors of elections; supervisors
of assessments in the several counties; the deputy and assistant
attorneys general and all other attorneys employed in, or connected
with, the State Law Department, except where a specific statutory
provision includes any such person in the classified service; the gen-
eral counsel and assistant general counsel of the Public Service Com-
mission; with the exception of the Commissioner of Motor Vehicles,
members of boards and commissions and all other persons holding
positions by direct appointment from the Governor or from the Board
of Public Works; all secretaries, chief clerks, and chief administrative
