(House Bill 357)
AN ACT to repeal and re-enact, with amendments, Sections 694(a),
(b), (e) and (g) of Article 43 of the Annotated Code of Mary-
land (1965 Replacement Volume), title "Health," subtitle "Air
Pollution," increasing the size AND PROVIDING FOR THE
MEMBERSHIP of the Air Pollution Control Council changing the
number required for a quorum, changing times of meetings of
the Council, and correcting an error therein.
Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 694(a), (b), (e) and (g) of Article 43 of the An-
notated Code of Maryland (1965 Replacement Volume), title
"Health," subtitle "Air Pollution," be and they are hereby repealed
and re-enacted, with amendments, to read as follows:
694.
(a) There is hereby created, as an agency of the State, an Air
Pollution Control Council consisting of [five (5)] nine (9) members,
all of whom shall be appointed by the Governor. One of said mem-
bers shall be appointed from a list of three (3) names submitted by the
Baltimore section of the American Society of Mechanical Engineers,
one of said members shall be appointed from a list of three (3)
names submitted by the Maryland section of the American Institute
of Chemical Engineers, and two of said members, who are at the
time employed by persons carrying on a manufacturing or public
utility business within the State, shall be appointed one from each
of two lists of three (3) names submitted by the [Baltimore Asso-
ciation of Commerce] Chamber of Commerce of Metropolitan Balti-
more, Inc. Each of said members shall be experienced and com-
petent in matters of air pollution control. [The remaining] One
member shall be a doctor of medicine and shall be appointed from a
list of three (3) names submitted by the Board. The remaining
members shall be appointed one each from a list of not less than
three (3) names to be submitted by the President of the University
of Maryland, the President of the Johns Hopkins University, the
Chairman of the Washington Suburban Sanitary Commission THE
CHAIRMAN OF THE BOARD OF DIRECTORS OF THE COUNCIL
OF GOVERNMENTS OF METROPOLITAN WASHINGTON, and
the President of the Maryland State-D. C. AFL-CIO. The Governor
in making his appointments shall give due consideration to repre-
sentation from the various geographic areas of the State, WITH
AT LEAST ONE MEMBER ACTIVELY ENGAGED IN FARMING
AND WHO IS KNOWLEDGEABLE IN FARM AND RURAL POL-
LUTANT PROBLEMS.
(b) Each member shall be appointed for a term of five (5)
years and shall serve until a successor is appointed and qualified;
provided, however, that of the first appointees, one shall hold office
for a period of one year, [one] two shall hold office for a period of
two years, [one] two shall hold office for a period of three years, and
[one] two shall hold office for a period of four years and [one] two
shall hold office for a period of five years.
