TION 118 (L) TO SAID ARTICLE AND SUBTITLE, TO FOL-
LOW IMMEDIATELY AFTER SECTION 118 (K) THEREOF;
AND TO REPEAL SECTIONS 121 (B) AND 121 (C) THERE-
OF, GENERALLY AMENDING THE MARYLAND COMMER-
CIAL FEED LAW OF 1958.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 121 (a) of Article 48 of the Annotated Code of Mary-
land (1965 Replacement Volume), title "Inspections", subtitle "Mary-
land Commercial Food Law of 1958", be and it is hereby repealed and
re-enacted, with amendments, to read as follows:
THAT SECTIONS 118 (B), 118 (F), 118 (K), 119 (A), 120 (C),
120 (D), 121 (A), and 124 (B) OF ARTICLE 48 OF THE ANNO-
TATED CODE OF MARYLAND (1965 REPLACEMENT VOL-
UME), TITLE "INSPECTIONS", SUBTITLE "MARYLAND COM-
MERCIAL FEED LAW OF 1958", BE AND THEY ARE HEREBY
REPEALED AND RE-ENACTED, WITH AMENDMENTS; THAT
A NEW SECTION 118 (L) BE AND IT IS HEREBY ADDED TO
SAID ARTICLE AND SUBTITLE, TO FOLLOW IMMEDIATELY
AFTER SECTION 118 (K) THEREOF; THAT SECTIONS 121
(B) AND 121 (C) THEREOF BE AND THEY ARE HEREBY
REPEALED, AND ALL TO READ AS FOLLOWS:
121.
(a) There shall be paid to the State Board of Agriculture for each
commercial feed distributed in this State an annual registration fee
of $10.00 and an inspection fee at the rate of 5 cents per ton; pro-
vided, however, that customer formula feeds are exempted if the
inspection fee is fee is paid on the commercial foods which they contain;
provided, further that said inspection fee shall not be paid on any
feeds which the distributor uses in feeding (1) animals on its own
or leased farms and/or (2) contract animals wherein the distributor
retains title thereto; and provided, further that distribution of com-
mercial foods to manufacturers or exchanges between them are
hereby exempted if the commercial foods so distributed or exchanged
are used solely in manufacture of foods which are registered; and
provided, further, that any distributor shall pay an annual registra-
tion fee of twenty-five dollars ($25.00) for each brand of commer-
cial feed distributed in individual packages of 10 pounds or less, and
the distributor of such brand shall not be required to pay the inspec-
tion fee on such packages of the brand so registered. Where a person
distributes commercial feeds in packages of 10 pounds or less and
in packages over 10 pounds the annual registration fee shall be
$10.00 per brand and the inspection fee shall be 5 cents per ton as
provided in this subtitle. Registration and inspection fees shall con-
stitute a fund for the payment of the cost of the inspection, sampling,
analysis and other expenses necessary for the administration of this
subtitle.
118.
(B) THE TERM "DISTRIBUTE" MEANS TO EXCHANGE,
OFFER FOR SALE, SELL, OR BARTER COMMERCIAL FEED,
CUSTOMER-FORMULA FEED, OR CONTRACT FEED, OR TO
SUPPLY, FURNISH, OR PROVIDE COMMERCIAL FEEDS,
