PITALS OR HOMES, OR IN HOTELS, MOTELS AND AMBU-
LANCE SERVICES.
(7) ANY INDIVIDUAL EMPLOYED IN MOTION PICTURE
THEATRES, INCLUDING DRIVE-IN THEATRES, AND LEGITI-
MATE THEATRES.
(8) ANY INDIVIDUAL WHO IS A STUDENT REGULARLY
ENROLLED IN PRIMARY AND SECONDARY SCHOOLS WHO
IS EMPLOYED AFTER SCHOOL HOURS OR DURING VACA-
TION.
(9) ANY INDIVIDUAL EMPLOYED AS AN OUTSIDE SALES-
MAN OR ANY INDIVIDUAL COMPENSATED ON A COMMIS-
SION BASIS.
(10) ANY INDIVIDUAL WHO HAS ATTAINED THE AGE OF
62 YEARS AND WHO WORKS NOT MORE THAN 25 HOURS
PER WEEK.
(11) ANY INDIVIDUAL EMPLOYED BY ANY EMPLOYER
ENGAGED IN THE FIRST PROCESSING OF, OR IN CANNING,
PACKING OR FREEZING PERISHABLE OR SEASONAL FRESH
FRUITS, VEGETABLES OR HORTICULTURAL COMMODITIES,
POULTRY OR SEAFOOD.
(12) ANY INDIVIDUAL EMPLOYED IN ANY HOTEL,
MOTEL, PARKING LOT, CAR WASH, OR BY ANY TAXICAB
COMPANY.
(f) "Committee" refers to an Advisory Committee, appointed by
the Commissioner, GOVERNOR, composed of not more than three
representatives of employers, an equal number of representatives of
employees, and an equal number of disinterested persons represent-
ing the public;
(g) "Occupation" means any occupation, service, trade, business,
industry, or branch or group of industries or employment or class
of employment in which individuals are gainfully employed;
(h) "Gratuities" mean voluntary monetary contributions received
by an employee from a guest, patron, or customer, for service ren-
dered, and no part of which shall be returned to the employer.
83. (a) Except as may be provided pursuant to this Act, every
employer shall pay to each of his employees wages at a rate of not
less than $1.00 an hour during the first two years from the effective
date of this Act, not less than $1.15 and hour during the third year,
and not less than $1.25 an hour thereafter.
84. (a) The Commissioner or his authorized representative shall
have the authority and it shall be his duty to vigorously enforce the
policies of this Act. He shall:
(b) No employer shall employ any of his employees for a work-
week longer than forty hours unless such employee receives com-
pensation for his employment in excess of 44 hours in a work week
at a rate of not less than one and one-half times the hourly rate
which the established minimum hourly rate is $1.00 per hour, time
and one-half after 42 hours while the rate is $1.15 per hour; time
and one-half after 40 hours while the rate is $1.25 per hour.
