the Commission to be critical, and not included in the official "needs
study program" of the Commission hereinabove referred to.

211-1. Any funds not expended by the Commission from the
amounts herein annually authorized for future right-of-way acquisi-
tion, future engineering and design costs, [and] overlays and
improvement of highways and critical highway construction and
reconstruction projects
shall revert to the Construction Fund of the
Commission and shall be expended by resolution of the Commission
for projects included in the document entitled "Highway Construc-
tion Program, Fiscal Years 1965 through 1970" or for projects
included in the official "needs study" program of the Commission,
provided, however, such project or projects shall be included in the
two-year highway construction programs hereinafter referred to in
this sub-title, and further, provided, that if any such funds shall
become available after any such two-year programs are submitted
to the local officials, as provided in Section 211J of this article, but
within six months before the next regular programs are scheduled
for submission, the Commission shall submit a supplemental pro-
gram to the county or counties involved and included therein the
project or projects to be constructed and, in either case, the right of
substitution provided in Section 211J shall be permitted.

SEC. 2. And be it further enacted, That this Act shall take effect
June 1, 1965.

CHAPTER 686
(Senate Bill 314)

AN ACT to repeal and re-enact, with amendments, Section 281 (c)
of Article 66C of the Annotated Code of Maryland (1957 Edition),
title "Natural Resources", sub-title "Part 2. Tidal Waters", to per-
mit the use of gill nets of a limited size at specified times of the
year in the waters of St. Catherine's Sound in St. Mary's County.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 281 (c) of Article 66C of the Annotated Code of Mary-
land (1957 Edition), title "Natural Resources", sub-title "Part 2.
Tidal Waters", be and it is hereby repealed and re-enacted, with
amendments, to read as follows:

281.

(c) It shall be unlawful for any person to set fish traps or nets or
haul seine in the waters of St. Catherine's Sound in the waters of St.
Mary's County, except that the use of gill nets not exceeding a
length of 90 yards shall be permitted during the months of March,
April and May.

     SEC. 2. And be it further enacted, That this Act shall take effect

June 1, 1965.
