SIONS SYSTEM OF THE MARYLAND STATE POLICE AND
ACCEPTABLE TO THE STATE POLICE DEPARTMENT EM-
PLOYEE CONCERNED, TO BE PHYSICALLY INCAPABLE OF
PERFORMING HIS DUTIES.
IF ANY MEMBER OF THE OLD RETIREMENT AND PEN-
SION SYSTEM OF THE MARYLAND STATE POLICE DIES
BEFORE RETIREMENT, OR AFTER RETIREMENT FROM
SERVICE ON A PENSION, THERE SHALL BE PAID TO HIS
WIDOW, IF ANY, AND TO CONTINUE DURING HER WIDOW-
HOOD, A PENSION EQUAL TO TWENTY-FIVE PER CENTUM
OF HIS ANNUAL REMUNERATION. IF THE MEMBER DOES
NOT LEAVE A SURVIVING WIDOW BUT THERE IS OR ARE
A SURVIVING CHILD OR CHILDREN, ANY OR ALL OF WHOM
ARE UNDER THE AGE OF 18 YEARS, THE PENSION SHALL
BE PAID TO THE SURVIVING CHILD OR CHILDREN WHO
ARE UNDER THE AGE OF 18 YEARS, IN EQUAL AMOUNTS
TO EACH. ANY PAYMENTS MADE TO A WIDOW UNDER
THIS SECTION SHALL TERMINATE ON EITHER THE DEATH
OR REMARRIAGE OF THE WIDOW. IN EITHER EVENT IF
THERE IS OR ARE A CHILD OR CHILDREN OF THE DE-
CEASED MEMBER, WHO ARE UNDER THE AGE OF 18
YEARS, THE PAYMENTS UNDER THIS SECTION SHALL CON-
TINUE TO SUCH CHILD OR CHILDREN IN EQUAL AMOUNTS.
PAYMENTS UNDER THIS SECTION TO THE WIDOW OF A
MEMBER SHALL CONTINUE FOR THE DURATION OF HER
NATURAL LIFE, UNLESS SHE REMARRIES. IF THE WIDOW
BENEFICIARY HAS DIED OR HAS REMARRIED, AS IN THIS
SECTION SPECIFIED, PAYMENTS TO ANY SURVIVING
CHILD SHALL TERMINATE WHEN HE REACHES THE AGE
OF 18 YEARS. IF A PENSION IS PAID UNDER THIS SECTION,
IT SHALL IN NO EVENT BE LESS THAN $100.00 PER MONTH
IN THE AGGREGATE. A WIDOW, CHILD, OR CHILDREN RE-
SULTING FROM ANY MARRIAGE CONTRACTED AFTER THE
RETIREMENT OF THE MEMBER ARE NOT ELIGIBLE FOR
ANY PAYMENTS UNDER THE PROVISIONS OF THIS SUB-
TITLE. FOR THE PURPOSES OF THIS SECTION THE REMU-
NERATION OF A RETIRED MEMBER SHALL BE COMPUTED
AS IT WAS IN THE YEAR IMMEDIATELY PRECEDING THE
GRANTING OF THE MEMBER'S APPLICATION FOR RETIRE-
MENT. WITH RESPECT TO A MEMBER WHO DIES WHILE IN
SERVICE THE WORD "REMUNERATION" SHALL BE COM-
PUTED AS IT WAS IN THE YEAR IMMEDIATELY PRECED-
ING THE DATE OF HIS DEATH.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1965.
