until the same be paid in whole or in part, or the transfer of title
is made to depend upon any condition therein expressed, and posses-
sion is to be delivered to the vendee, is to be recorded; and such
recording shall contain a brief description of the goods and chattels
in such paper writing mentioned, the date thereof, the amount due
thereon, when and how payable and the names of the vendor, vendee,
payee, guarantor and witness, if any, or such names in plural if
they so appear; and the said clerk shall index the names of the
parties to said paper writing and shall receive therefor a reasonable
and just compensation but not more for said work than is now
provided by law for the recording of other conveyances which require
the same amount of work.]
ARTICLE 52
29.
[(a) Whenever a justice of the peace shall vacate his office by
resignation, removal from office, or the expiration of his official term,
he shall deliver his docket, together with all the notes, bonds, accounts
and papers in his possession appertaining to judgments or where-
upon suits have been entered, to the clerk of the circuit court for
the county in which such justice resides, within thirty days after
such resignation, removal from office, or expiration of official term;
and any justice of the peace who shall fail to deliver his docket, as
aforesaid (in case the said docket shall not have been unavoidably
lost or destroyed), shall be deemed guilty of a misdemeanor and on
conviction thereof shall be subject to a fine of two hundred dollars
or to six months imprisonment in the jail of the county at the
discretion of the court.
(b) Provided however that in the City of Frederick the records
of the justice of the peace shall be kept by the clerk of the justice's
court and not transmitted as hereinbefore provided. Any successor
justice of the peace may hear and decide cases instituted prior to
his succession to office. Provided further that any papers held by
the clerk in Frederick City for a period of three years or longer
may be destroyed as provided in Sections 177, 178 and 180 of Article
41 of this Code and the clerks shall be relieved of the responsibility
of delivering transcripts of the same as hereinafter provided.]
30.
[If a justice of the peace dies, the delivery provided for in Section
29 shall be made by his administrator or other person in whose hands
the said docket, notes, bonds, accounts and papers may be within
thirty days after receiving the same; and such administrator or
other person shall be subject to the same penalty for neglect or
failure to make such delivery which is appointed in Section 29.]
31.
[The clerks to whom such dockets and papers are delivered shall
keep the same as other records and shall deliver transcripts from the
dockets or papers so returned to any person applying for the same,
except that papers which have been in the custody of the clerks for a
period of three years or longer may be disposed of in accordance with
the provisions of Sections 177, 178 and 180 of Article 41 of this
