748                               LAWS OF MARYLAND                       [CH. 537

Maryland), title "Howard County", and sub-title "County Com-
missioners and County Collectors", as added by Chapter 529 of the
Acts of 1961, be and it is hereby repealed and re-enacted, with
amendments, to read as follows:

61A.

Any regular employee of Howard County shall have the right to
retire, and the Board of County Commissioners may effect the retire-
ment of any such employee, when he or she shall have reached the
age of 65 years. In the event that such employee shall have been
employed by said County for a period of 15 years prior to the date
of his or her retirement under the provisions hereof, the said Board
of County Commissioners is hereby authorized and empowered to
pay unto such retired person an annual sum of $1,200.00, payable
in equal monthly installments on the first day of each and every
month during the lifetime of such retired person, accounting from
the date of such retirement. Provided, however, that no employee
shall be entitled to commence receiving the benefits of this Act
unless he is retired on or before June 30, 1965, except as hereinafter
provided.

Any person who is a regular employee of the County on June 30,
1965, must be a member, of the State of Maryland Employees Retire-
ment System as of said date in order to be eligible for the supple-
mental benefits of this section as hereinafter defined and created.

No employee, even though otherwise entitled, shall be entitled to
receive the benefits of the pension under this section if he is a
member of the State of Maryland Employees Retirement System
and eligible at the time of his retirement to receive retirement benefits
under the State of Maryland Employees Retirement System, unless
the maximum benefit to which he would be entitled to receive under
any plan of benefit under the State of Maryland Employees Retire-
ment System would be less than Twelve Hundred Dollars per annum.
In the event that an employee who is a member of the State of
Maryland Employees Retirement System is entitled to maximum
benefits totalling less than Twelve Hundred Dollars per annum and
said employee also being entitled to the benefits of this section, then
and in that event, the Board of County Commissioners is hereby
authorized to pay to said employee a supplemental pension in such
amount as to provide the difference between the benefit conferred
by the State of Maryland Employees Retirement System and a total
annual benefit of Twelve Hundred Dollars.

[The term "regular employee" as used herein shall not be con-
strued to include an employee who is employed periodically or
intermittently nor any person who performs on a contractual basis.]

The term "regular employee" as used herein shall mean any regular
employee of the Board of County Commissioners of Howard County
and regular employee of the Board of Education of Howard County,
not covered by the provisions of the Teacher's Retirement System.

Nothing herein contained shall have the effect of limiting the power
of said Board of County Commissioners to discharge any County
employee. Nor shall nothing contained herein have any effect upon
the rights and upon privileges conferred by this section upon those
persons already retired under its provisions.
