by any rule or regulation of the [Commission of Tidewater Fish-
eries] Department of Chesapeake Bay Affairs; provided, however,
that the linear measurement along the shore line for the first such
area shall not exceed a distance of 100 yards for each landowner.
In the event that there shall be more than one such private bathing
beach belonging to the same landowner, or one private bathing beach
which extends for a distance of more than 100 yards, the [Commis-
sion of Tidewater Fisheries] Department of Chesapeake Bay Affairs
may in their discretion issue a numbered permit for more than one
such private beach or for an area in excess of 100 yards. Any
extended area or areas shall be marked and the areas designated as
the [Commission of Tidewater Fisheries] Department of Chesapeake
Bay Affairs
shall prescribe in its rules and regulations, or

(5) On Sunday, or between sunset and [one-half hour after]
sunrise on any other day, or to land soft shell clams before sunrise
or later than one (1) hour after sunset.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1965.

CHAPTER 510
(Senate Bill 385)

AN ACT to repeal and re-enact, with amendments, Section 325 (a)
of Article 77 of the Annotated Code of Maryland (1964 Supple-
ment), title "Public Education", sub-title "Chapter 35. Advisory
Council for Higher Education", to remove a CHANGING THE
limitation on the qualifications of persons for membership on the
Advisory Council for Higher Education.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 325 (a) of Article 77 of the Annotated Code of Mary-
land (1964 Supplement), title "Public Education", sub-title "Chapter
35. Advisory Council for Higher Education", be and it is hereby re-
pealed and re-enacted, with amendments, to read as follows:

325. (a) There is established the Advisory Council for Higher
Education consisting of nine members who shall be appointed from
the citizens of the State by the Governor with the advice and consent
of the Senate. The members of the Council shall be selected by the
Governor solely by reason of their demonstrated interest in the broad
range of higher education, their knowledge and understanding of its
needs and problems and their devotion to its cause [, but no NOT
MORE THAN two members shall have attended the same institution
of higher learning]. Each member shall be appointed for a term of
six years from the first Monday in June in the year of his appoint-
ment; provided that of the initial appointments three shall be for
terms ending the first Monday of June, 1966, three shall be for terms
ending the first Monday of June, 1968, and three shall be for terms
ending the first Monday of June, 1970, respectively. Each member
shall serve until his successor qualifies and shall be eligible for
