439. Penalties.

(a)    Obstruction, etc., of State Veterinarian or authorized agent.
Any person convicted of violating any of the provisions of this
subtitle or the rules and regulations issued thereunder or who shall
impede, obstruct, hinder, or otherwise prevent or attempt to prevent
said State Veterinarian or his duly authorized agent in performance
of his duty in connection with the provisions of this subtitle, shall
be adjudged guilty of a misdemeanor and shall be fined not more
than $100 for the first violation, and not less than $100 or more than
$500 for a subsequent violation.

(b)    Duty of State's attorney. It shall be the duty of the State's
attorney to whom any violation is reported to cause appropriate
proceedings to be instituted and prosecuted in a court of competent
jurisdiction without delay. Before the State Veterinarian reports a
violation for such prosecution, an opportunity shall be given the
person, auction market, sales agency, dealer or trucker or hauler to
present his view.

(c)    Injunction. The State Veterinarian is hereby authorized to
apply for and the court to grant a temporary or permanent injunc-
tion restraining any person from violating or continuing to violate
any of the provisions of this subtitle or any rules or regulations
promulgated under the subtitle notwithstanding the existence of
other remedies at law. Such injunction shall be issued without bond.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1965.

CHAPTER 422
(House Bill 749)

AN ACT to repeal and re-enact, with amendments, Section 712 (f)
(6) of Article 66C of the Annotated Code of Maryland (1964
Supplement), title "Natural Resources," subtitle "Oysters and
Clams," to increase the period wherein it is lawful in Worcester
County to take or catch clams by hand scrape and/or shinnecock
rake.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 712 (f) (6) of Article 66C of the Annotated Code of
Maryland (1964 Supplement), title "Natural Resources," subtitle
"Oysters and Clams," be and it is hereby repealed and re-enacted,
with amendments, to read as follows:

(f) (6) Season. It shall be unlawful to take or catch clams by
hand scrape and/or shinnecock rake in Worcester County except from
[October] November 4 OCTOBER 15 in each year to [April] March
30 APRIL 15, both dates inclusive.
