CHAPTER 397
(House Bill 518)

AN ACT to repeal and re-enact, with amendments, Sections 40 (p),
40 (p) (2), 40 (p) (3), 40 (p) (4) and, 40 (p) (5), and 40 (p) (6) of
Article 10 of the Annotated Code of Maryland (1957 Edition and
1964 Supplement), title "Attorneys at Law and Attorneys in Fact,"
subtitle "State's Attorney," subheading "Salaries and expense al-
lowances of county State's Attorneys," relating to the salaries and
the duties of the State's Attorney, Deputy State's Attorney,
Assistant State's Attorneys and other employees of the State's
Attorney's Office in Montgomery County, Maryland, and author-
izing the Assistant State's Attorneys to present cases to the
Grand Jury and increasing the minimum salaries of the State's
Attorney, the Deputy State's Attorney, the Assistant State's
Attorneys and the special investigator, and imposing a ceiling
on such salaries, and reducing the number of authorized Assistant
State's Attorneys, and providing that the State's Attorney, the
Deputy State's Attorney and the Assistant State's Attorneys
shall be full time employees who shall not engage in the private
practice of law, and further providing that the special investigator
shall be a full time employee who shall not engage in other em-
ployment, with an exception thereto., AND FURTHER PROVID-
ING FOR A REASONABLE EXPENSE ALLOWANCE SUB-
JECT TO THE APPROVAL OF THE COUNTY COUNCIL FOR
THE OFFICE AND DUTIES OF THE STATE'S ATTORNEY.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 40 (p), 40 (p)(2),40 (p)(3),40 (p) (4) and, 40 (p)(5),
AND 40 (p) (6) of Article 10 of the Annotated Code of Maryland
(1957 Edition and 1964 Supplement), title "Attorneys at Law and
Attorneys in Fact," subtitle "State's Attorney," subheading "Salaries
and expense allowances of county State's Attorneys," be and they
are hereby repealed and re-enacted, with amendments, to read as
follows:

40.

(p) Montgomery County.—In Montgomery County, (1) the State's
Attorney's salary is [twelve thousand five hundred dollars ($12,500).]
twenty thousand dollars ($20,000) per annum. The State's Attorney
shall devote his full time and attention to the duties of his office
as State's Attorney and shall not engage in the private practice of
law at any time in any jurisdiction during his tenure of office.

(p) (2) The State's Attorney may appoint a deputy State's At-
torney and [six] four assistant State's attorneys. The deputy
State's attorney's salary shall be not less than [six thousand dollars
($6,000), ] thirteen thousand dollars ($13,000) nor more than fifteen
thousand dollars ($15,000) to he determined
[and this compensation
may be increased] by the County Council in its discretion. The
assistant State's attorneys' salaries shall be not less than [four
thousand five hundred dollars ($4,500)] eight thousand dollars
($8,000)
each [,] nor more than ten thousand dollars ($10,000) each
to he determined
[and this compensation may be increased] by the
County Council in its discretion. [The State's Attorney may appoint
