320                                   LAWS OF MARYLAND                         [CH. 294

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 31 of Article 26 of the Annotated Code of Maryland
(1964 Supplement), title "Courts," subtitle "Circuit Court for the
Counties—Court Stenographers," be and it is hereby repealed and
re-enacted, with amendments, to read as follows:

31.

No case at law or in equity shall be docketed in the circuit courts
for Howard, Caroline, Cecil, Kent, Queen Anne's and Washington
counties until the clerk of the circuit court for the applicable county
shall have been paid the initial costs therefor. The initial costs for
docketing an equity case shall be fifteen dollars ($15.00) and for
docketing a law case, ten dollars ($10.00). However, in any such case
where the party is indigent and files an oath "in forma pauperis," this
section shall not apply.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1965.

CHAPTER 294
(House Bill 1158)

AN ACT to repeal and re-enact, with amendments, Section 38 (a)
of Article 66B of the Annotated Code of Maryland (1964 Supple-
ment), title "Zoning and Planning," subtitle "Historic Area Zon-
ing," amending the laws concerning historic area zoning in order
to make this subtitle effective in Montgomery County.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 38 (a) of Article 66B of the Annotated Code of Mary-
land (1964 Supplement), title "Zoning and Planning," subtitle "His-
toric Area Zoning," be and it is hereby repealed and re-enacted, with
amendments, to read as follows:

38.

(a) The preservation of structures of historic and architectural
value is a public purpose in this State. The board of county com-
missioners or county council of every county in the State in those
counties in which this subtitle is effective and the mayor and city
council, by whatever name known, of every municipal corporation
in this State in those counties in which this subtitle is effective have
power by ordinance or resolution to regulate the construction, altera-
tion, repair, moving, and demolition of such structures within their
respective limits. Hereafter in this subtitle such counties and munic-
ipal corporations are referred to as "county" or "counties" or "munic-
ipal corporations" as the case may be. This subtitle is effective only
in the counties of Anne Arundel, Carroll, Cecil, Charles, Frederick,
Harford, Howard, Kent, Montgomery, Prince George's and St.
Mary's.
