308                             LAWS OF MARYLAND                     [CH. 284

title "Frederick County," subtitle "Part I. General Local Laws,"
subheading "Chapter 13. Roads and Public Grounds," to change
the date of the annual report of the county engineer of the pro-
posed road construction and maintenance program in Frederick
County and relating to said report and the duty of the county
engineer to carry out said program in general.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 13-10 of the Code of Public Local Laws of Frederick
County (1959 Edition, being Article 11 of the Code of Public Local
Laws of Maryland), title "Frederick County," subtitle "Part I. Gen-
eral Local Laws," subheading "Chapter 13. Roads and Public
Grounds," be and it is hereby repealed and re-enacted, with amend-
ments, to read as follows:

13-10.

On or before the first day of October in each year, the county
[roads] engineer shall prepare and submit to the county roads board
a proposed road construction and maintenance program, supple-
mented with plans as he may see fit, of road and bridge work, repair
and construction in the county for the ensuing [fiscal road] calendar
year, showing as closely as may be the available funds and how they
are to be expended and on certain roads and bridges, naming such
roads and bridges, the character in detail of the work involved, and
the estimated cost of each construction project, [what proportion of
the road money is for new construction, what proportion is for main-
tenance and repairs and what proportion is set apart and reserved
for salaries, incidentals and contingencies, in detail]. Notice of the
filing of such report embracing such comprehensive program of road
construction and maintenance for the ensuing [fiscal] calendar year
shall be published by the county roads board in a newspaper regularly
published in the county, the first publication to be within one week of
the filing of the report.

Such publication shall also indicate that during the month of
[October] November, the program will be available at the office of
the county road board for review by any interested person.

On or before the first day of [November] December, the county
commissioners shall have power to change, alter or modify such com-
prehensive program of the county roads board, but such comprehen-
sive program, as submitted or as changed, altered or modified by the
county commissioners on or before the first day of [November]
December, shall be binding upon the county roads board during the
ensuing [fiscal road] calendar year; provided, that if any necessary
right of way cannot be obtained, the county roads board shall have
the power to provide for an alternative route or program, subject to
the approval of the county commissioners. It shall be the duty of the
[roads engineer to see that such program is carried out in every par-
ticular, insofar as funds are available, and he shall have power to
employ and discharge labor as necessary, subject to the approval of
the county commissioners.] county engineer to see that such program
is completed in the best manner possible.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1965.
